I have registered as a creditor to the liquidation officer through the gov website and explained my situation. Surely Omni will be doing the same? How can they claim from the gov and seek the money from me too?It clearly states in the credit agreement that there is NO agreement unless “goods” have been received? So how can they uphold this.

Go back to Omni stating you are claiming under S75 & as such they are jointly and severally liable, for the breach of contract & misrepresentation. On the fact that you will not be receiving the service paid for.

I my deposit in Feb, first payment was made July 5th however my bank refunded it under goods not received.
Apparently I am not eligible for section 75 as I paid for my direct debit finance with a debit card.Omni are sending me letters and emails still chasing the money.Apparently they have paid skin the full amount as skn notified them that I had started treatment for that block. I hadn’t, I had only booked my first treatment which was due in September.…0 -
The fact that they have paid sk:n doesn't matter. The fact that you have paid on debit card doesn't matter. The only thing that matters is what sort of credit agreement it was.
If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -

If it is not resolved you can take it to FOS.

Thanks for your comments.I think a strongly worded email will be my next port of call with a threat to report them to the ombudsman for breaching the credit agreement.It clearly states in the above screenshot that if the goods/services have not been received and/or within 6 months then there is no agreement.I explained to them that I have had no treatment from this block but I did have an appointment scheduled and I believe this is why Sk:n triggered the start of the payments. I have the email record of me questioning Sk:n as to why this happened.Is an official complaint to go through customer services or should that be a different thing all together?Thanks for your help this far.0

Hi
I am the exact same situation as you. I would appreciate any updates you get with this.
I signed up to a 6 month contract with Omni for a block treatment of laser hair removal through Sk:n.
I have only had one treatment and still owe £500+ on the loan.
Omni have also advised me that as my loan is less than 12 months, it is 'unregulated' and I must continue paying the direct debit otherwise they will pursue me for the money and cancelling any direct debits will severely affect my credit score. They sent me the link to the GOV website to apply as a 'creditor' to the Official Receiver to try and re-coup the money but I will have to pay the 5 further instalments before I can attempt to re-coup any money.
It would be good to know when Omni found out about the liquidation as I signed my agreement on 16th and Sk:n went into liquidation on 17th. Had I have been informed of this I could have been within my statutory 14 day cooling off period to cancel the agreement. I only found out yesterday Sk:n went into Liquidation when I called Sk:n to confirm my next treatment! Surely Sk:n/Omni have a duty of care to inform their customers that service has ceased and Sk:n shouldn't have let a customer sign a 6 month agreement the day before they go under knowing full well they weren't going to be able to provide the services.
I also saw this part of the contract regarding advancing the money to the credit intermediary and thought this doesn't make sense. It makes it sound like they don't actually pay Sk:n in full until the treatment is complete i.e the last course of treatment..? and how does that wording stand when 6 months' have passed since signing the agreement and we have still not received the treatment in full?
The next instalment of £101 is due tomorrow through direct debit and I really don't know whether to cancel it or not.
So upset by the whole thing and don't know where to turn. Any advice/help much appreciated.

Hi All,
I have now received my final response detailing that I still have to pay in their eyes.They have also added in “terms” that were never on the original agreement I signed. They are trying to say that when you sign the agreement you are confirming you have had your first treatment. Ermm pretty sure that’s fraud as that’s not what is in the agreement 😂
citizens advice is your best point of call, I would also start leaving reviews on all of omni’s online platforms. Best to ward off others.It also states that if no treatments are received within 6 months then there is no agreement.I think I will end up going to small claims court.0 -
