Claim defence email to CNBC was deleted without being read

Following the process described in these forums for acknowledging and responding to a parking claim (Euro Car Parks Limited), I created a defence document and emailed it to ClaimResponses.CNBC@justice.gov.uk as a PDF.

I received the standard auto reply, thanking me for emailing the Claim Responses Team in the Civil National Business Centre and that I could expect a response in 10 days.

The document attached complied with the Practice Direction 5B described in the auto reply.

6 days later I have received a second email from the Claim Responses Team:

was deleted without being read on Thursday, July 25, 2024 8:41:25 AM (UTC+00:00) Dublin, Edinburgh, Lisbon, London.

To: ClaimResponses.CNBC
Subject: IMPORTANT - CLAIM ******** - DEFENCE DOCUMENT ATTACHED
Sent: Friday, July 19, 2024 9:34:56 AM (UTC+00:00) Dublin, Edinburgh, Lisbon, London
I am assuming that this in not typical.  Any advice as to how to proceed?

    On further investigation, the Status Summary on the MCOL website says the following:
    Your acknowledgment of service was submitted on 15/07/2024 at 13:26:07
    Your acknowledgment of service was received on 15/07/2024 at 16:05:13
    Your defence was received on 24/07/2024
    This seems like sufficient confirmation that I have completed all of the steps up to the defence.  Is this the case or should I take any additional action?

    (I have also completed and returned the N180 to the Directions Questionnaire Team in the Civil National Business Centre, and have received an auto reply confirming receipt)

    Within the last week or more several failures by the CNBC have been reported on here, some causing default CCJs in error, then those have been set aside and the defence logged like yours

    As long as the defence is logged then it should now proceed in the normal way, so follow the 12 steps in the defence template thread 

    It would not surprise me if the Cloudstrike incident last week disrupted the CNBC systems causing knock on issues

    Thanks for the reply.  I have followed the process to the letter so far, so I'll sit tight and wait for a little while.

    (I work in IT and didn't even consider that Crowdstrike could have disrupted CNBC systems!)

    Frankly, there are too many problems popping up within the last week, the problems do seem to be all at the CNBC and unusual, so its either being snowed under or IT issues, or both, so if their systems were affected then I can see why something might be deleted, then a defence logged several days later once they are fixing the consequences, which includes a few recent CCJ matters that have been set aside, and many logs are dated yesterday, the 24th !  Coincidence. ? I don't think so , read this

    Moving forward, yours seems to be back on track with no CCJ set aside so no CCJ letter should arrive either

    If the CNBCs errors have cause you distress and/or anxiety, you should direct a complaint to the manage of the CNBC. They are likely to offer a compensation payment of ~£250. You may have to hurry as they may run out of funds with so many of these "errors" occurring lately.

    And of course the ppc's are rubbing their hands with glee as they hit the "nuclear button" issuing a malevolent CCJ instantly  knowing full well the CNBC backlog and the absolute misery thus caused to the general public.

    I would be checking with CNBC that they have not deleted your defence!  Did you send the DQ - N180 that you received from CNBC or one that you had downloaded?  Maybe that is the e-mail they deleted?  They don't like it if you send a N180 before they have sent the blank to you.

    I did pre-emptively send the N180 that I downloaded from this forum. However that goes to a different email address and I referenced my messages so I l ow the “did not read” response was regarding my defence document. 

    MCOL says they got it and I have a copy that was CCed to my second address so I can prove delivery with the mail headers. 

    I’ll shot them another email but not sure what else I can do.

    IMHO, you should check MCOL twice a week and go by what is or isnt there 

    If the defence is logged, its logged, job number 1 done 

    If the N180 is logged, job number 2 done, but if its not logged, keep checking MCOL and if it says that they have posted the N180 to you, email the completed DQ to the DQ email address at the CNBC , once its logged you have no further involvement with the CNBC 

    Once everything is received and logged by the CNBC, the claim history will eventually show that its been transferred, usually to the court near you, the court you selected , that is job number 3 but for them to do 

    So just like a bank account, you keep an eye on the MCOL claim history, as a statement of the processing and progression, until its been transferred, after that the CNBC won't show anything further 

    So just check the progress online, ensuring that you do everything in order, and so do the CNBC too. !

    Read any and all postal letters from the CNBC too, but use the MCOL claim history to check the progress and email the dq when the claim history requires it, pointless jumping the gun because they have a process with timelines
