Received Claim Form but not a PCN

Options
Hi, please can someone help?
I have received a Claim Form but not received a PCN beforehand.

It is for Failing to purchase a ticket and/or within the time allowed, on a date in November 2023.
I used to park in this private car park daily, and I have found the ticket I purchased which this claim is referring to. So I'm guessing this claim form is for not purchasing a ticket "within the time allowed" (which I think is 10 mins).
Do I have a defence?
For me to park for 9 hours, I had to purchase the ticket which allowed parking for up to 12 hours, but I don't have evidence of why there was a delay of me purchasing the ticket.

As it was last year, I'm not sure what the issue was - it could have been : when I parked up I struggled to find my bank card and started panicking, I eventually started looking for cash, didn't have enough but then found my bank card; or there was a day that was very stressful on the road and when I parked, I stayed sat in my car to try and calm down and not let panic take hold.

I have looked at the helpful threads on here regarding the AoS and the defence template. I think I need to read it all again to fully understand all the info and stages.
Do I first need to ask for the evidence (PCN)? If so, do I email the legal rep, and request the evidence to be sent to me via email? (Post is unreliable)

Also, I go on holiday at the end of this week, so I'm worrying about timescale/deadlines and not being able to relax on holiday if I haven't achieved enough of this process beforehand.

Everybody has a defence, study the defence template thread in announcements near the top of the forum, plus read the newbies sticky thread in announcements too

What is the exact issue date on the claim form ? And who is the claimant and who is the lawyers involved. ?

Post a redacted picture of the POC on the left hand side, but cover up the VRM details

Do nothing yet, especially do not email a SAR yet

Information first, actions later, after targeted advice

    Yes you have a defence!

You DO NOT request any evidence,  no emailing anything (except the defence after checking it with us).

To stop you worrying about it why not do your defence before you go away, then it's done!

Use the Template Defence or the alternative wording linked in the third paragraph of that.

And get your logbook out today. it has your old address on it, doesn't it?  That's why you didn't get a PCN or chaser letters.  You MUST change that online with the DVLA.

Please show us the claim form but redact the Password, your Claim no., your data and VRM and any QR Codes.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When you show the claim form, please leave the amounts the are claiming showing as there is likely to some abuses of process that can be highlighted in your defence.

    Which PPC and which Solicitor?
  • Thank you for your comments. Here is the claim form.
My address is correct, so i don't know why i didn't receive any notices before this.
The defence template is all 30 points? Would i be challenged on any points, like number 4 - the claimant could have evidence of their signage being clear .. Other points i don't fully understand, would i be asked to explain or elaborate on these points at any time?

With a Claim Issue Date of 12th June, you have until Monday 1st July to file an Acknowledgment of Service, but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 15th July 2024 to file your Defence.
That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

No because there won't be a hearing!

You haven't read enough if you were not aware of what actually happens after you defend a DCB Legal claim.

  • I read quite a lot of the info in one go so got a bit overwhelmed. I am grateful for all the info on here but now I can't find the section where different legal reps have been mentioned and what happens when you defend against them. I just don't want to mess up any part of this process.

The newbies FAQ thread in announcements is one source of information

The defence template thread in announcements is a good source of information

The DISCONTINUATIONS thread by Umkomaas is an excellent resource documenting the failures by these companies

There isn't a section like that. But you seem to have missed reading to DCB Legal Discontinuances thread by @Umkomaas

  • Thank you all for your comments and info.
I have a tendency to over explain situations so not sure how much defence I should include, but I shall do a draft and post it here first. Thank you.
