    Doesn't matter if it is missed. A complaint gets it reset.  You could phone the CNBC.

    Thanks! It is received and updated on MCOL (states the 9th when it should’ve been there 2nd) I sent it 26th Aug…..I have a mediation appointment booked in - any tips? @Coupon-mad

    Hi @Coupon-mad I’ve had mediation and told them I’m not paying a penny. Was very polite and completed the duration of the call. I’m moneyclaim it says it is now with local court - Sheffield. Does that mean I will get a court date? Thanks

    @Coupon-mad do you think it will go that far? I would prefer a notice of discontinuance. It’s actually my partners claim and she’s not in a place to go to court.

    @Coupon-mad @KeithP @gr1p thanks for your help over past months. I have now received a court date. How do I prepare a witness statement? Is there a proforma form from the court I can download? And any chance of this being struck out?

    It will either get to a hearing or it won't ( won't meaning discontinued. ) the judge decides the outcome in a hearing, we cannot second guess that stage 

    There are no proforma or templates for the witness statement, so you should study recent approved examples and use them to build your witness statement plus Exhibits bundle

    Is everything being done in your partner's name. You can't do it 'on behalf of'. You can certainly do all the legwork in preparing court papers, but it must be completed under her signature. If it does get to a court hearing, she must attend. You can be with her and speak for her (Lay Representative - Google it), but she must be with you. 

    However, as you're dealing with DCBL, it likely won't get that far, but you must continue to work on the basis that it will. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
