They sent notice of intended prosecution last October 2023, I asked for a hard copy of their claim form and heard nothing back until now
    I don't think so!

Prosecutions are from official authorities, not private parking companies

It would have been a notice of intended court action. (. A Letter of Claim. ) ,  over a civil dispute

Not a prosecution, not a summons, just an intention of possible court action in the civil justice system, at a civil court

You now have that threat in the flesh, a civil court claim using the MCOL online claim system whereby the claimant makes the claim online with the appropriate fee and the CNBC in Northampton post out an N1SDT court claim to your address

You are now drafting and filing the defence to that civil court claim, once the AOS was completed online before day 19 following the issue date on your claim form , with a deadline for submission to avoid a possible default CCJ

So definitely not a threat of prosecution, just the intention of future court action in a civil court before the judge

The point is that nobody sent you anything that threatened prosecution.
But as whatever it was happened last October, it no longer has any relevance anyway.

Ok thank you, I guess the feedback is I need to wipe the slate clean, I thought that when they didn't respond to my request they had reduced their ability to claim, the issue for myself is I read up on it last year and have forgotten the procedure from then, I clearly need to catch up again. Thanks again for the clarification.

Come back when you arrive back in the UK. You can easily do the defence then because it's just a matter of adapting a template then emailing it.

Thank you, I'll probably start on my defence while here as it's hanging over me and I'd like to sort it
