Spusu final bill

I signed up to spusu on the 30/5/2024 for a 1 month contract and I activated the sim card on the 3/6/2024 but on the 24/6/2024 I decided to leave so I emailed spusu to find out when I could leave and they replied let us know and we can cancel for you. I then emailed them back saying I would like to leave on the 30/6/2024 and they sent confirmation but they didn't say there would be a termination fee for leaving in the first month so should I have paid the final bill because I've already paid up front for the first month.

    I don’t know the Spusu terms and conditions but generally there’s a minimum term to get the discounted rate. Unless you cancel after the minimum term then you are charged.

    I don't know if spusu knows the terms and conditions.

    On the website under FAQ it says there is no minimum contract period with spusu after the first full month. Our flexible monthly plans can be changed or cancelled every month.

    Spusu Terms & Conditions.
    1, In a nutshell.
    In principle, you do not have a minimum contract period with spusu. Your termination will take effect at the end of your current billing period.

    3, Your contract.
    If a plan is reduced in price or upgraded with additional free units as part of a promotion, the promotion conditions remain valid until the end of the contract term or until you change to another plan. A change of the plan is deemed to be a new contract. 

    6, Contract term & period of cancellation for mobile plans.
    Generally, there is no minimum contract period at spusu, and our contracts are concluded for an unlimited period. Cancellation of your contract or parts of your contract (e.g.: individual numbers or SIM cards) is possible at any time and always takes effect at the end of the month, i.e., at the end of the current billing period. We reserve the right to terminate your contract with at least a one-month notice. This means that your contract with us will finish at the end of the notice period or at a later date specified by us. If you terminate your contract within the first month after billing has started, we will have to charge you a one-off fee of £4.00 for your SIM card.

    3.3 Right of cancellation for mobile plans
    If you conclude your SIM-only contract in writing, by telephone or online (distance or off-premises contract) for our subscription service, you have 14 days to cancel your contract without giving any reason (the ‘cooling-off period’), but any use of our services may be billed accordingly. The cooling-off period begins from the moment you conclude a contract with us. You must notify us of your intent to cancel within the cooling-off period.
    You can cancel your plan automatically by using a PAC or STAC code, by contacting our Service Team, or by sending us the cancellation form. If you send the cancellation form by post, the date on the postage stamp is considered the date of submission. If you cancel the contract, you may be obliged to return the goods you have received from us within 14 days. Please note that we can only process signed cancellation forms, that you must bear the costs for the return of the goods, and that services which you have already used will be invoiced. You will find a template for the cancellation form on our website. If you wish to cancel by e-mail, please send us your signed and scanned cancellation form as an attachment.
    An early termination fee of £4.00 will be charged for a SIM card that has already been used and falls outside the ‘cooling-off period’ but within the first 30 days after the conclusion of the contract.

    I've also been charged the termination fee which I'm disputing. My situation differs from yours though as I cancelled within 14 days.

    Is there an update on your experience? Going through the same for my 1 month contract. Got myself a £1 e-sim on 10 July then submitted my PAC code on 24 July, which didn't port my number until 29th. I didn't realise their PAC code text said there was a small charge for early termination, their website says there is a £4 charge for a sim card cancelled in the first month although technically I had an e-sim so nothing was posted out to me. I didn't have good signal with them anyway so would have had to leave. If I knew I would have stayed until the end of the first month.

    Anyways, looking at the final bill, it's not entirely clear what I was charged for as it was higher than stated in their text, so I have emailed them to ask. I know I won't be using them again though. Should have known since they're partnered with EE who I had bad experience dealing with and I had very poor signal too.

    Begs the question, why did you sign up with a network that you knew gave you poor reception?

    I was with EE a couple of years ago when I lived in London, now I've moved out of London 4 hours away so thought there was no harm in trying again for 1 month to see if things had changed. Plus it showed there would be good coverage but my signal was always on the low end with Spusu. Good thing I didn't sign up to at least a 1 year contract like I normally would.

    When I emailed them they said After activating the SIM card, minutes, text messages and data are credited on a pro rata basis for the remaining days of your first month. The following month, all units included in your plan are available to you and you will only be billed proportionately from your point of activation in the first month.

    The billing period is always the calendar month. You will be given your full free units again at the beginning of the month.
  • In case someone is interested, I recently won a Communication Ombudsman case against Spusu for the fact that they didn't do pro-rata refund if you leave them in the middle of the month.

    The quote from the decision:


    * On 31 July 2024, you arranged to transfer your mobile number from Spusu to another network. The transfer took place on 2 August 2024.
    * However, Spusu charged you for the whole month of August 2024. You asked for a pro-rata refund but they refused and said this was not in line with their terms and conditions.
    * You chased Spusu for an update on <redacted> and <redacted> but they did not resolve the issue for you, and so you referred it to our service.
    * You said that Spusu should provide you with a pro-rata refund of <redacted>, and change their terms and conditions to be in line with Ofcom guidelines. As we’ve discussed, I unfortunately cannot require Spusu to change their terms, as this outside the scope of what our service can do. However, in their response to our service, Spusu did explain that their staff had misinformed you about the terms, and confirmed that you were indeed entitled to a pro-rata refund.
