URGENT - DCB Legal/UK Parking Control claim form

Hi,

I’m in urgent need of some help.

i used to visit a past partner in October 2023 at her apartment, I was advised by her that if i parked in the spaces that were not allocated i did not need to register.

In March 24 I received a claim form from DCB legal ( having received no prior letters to this, partly due to my vehicle’s log book not being updated )

the claim form states the reason was: registered users only.

at the time I was applying for a mortgage and panicked and paid for the two tickets totaling £260.60

thinking this was the last of this and taking it as a lesson I had heard nothing more until May 24, when I received a letter from DCB legal. At the time I thought they must not of registered that I’d paid the fine.

i called up and then they explained I had 7 tickets outstanding totaling £856.92 ( after already paying £260.60 )

they have since issued a claim form for this amount, on the 17th June 2024.

i filed an Acknowledgement of service 1/7/24

can anyone help as to what to do with this situation? I have proof that I was a genuine visitor, and proof she owns an apartment there, I was just given the wrong information and wasn’t aware I was getting a fine for every visit.

You never got a "fine" on any visit, all you received was a speculative invoice, by paying two you have now fallen in to their gullible pit you now need to read the newbies thread and start thinking about a defence.

Hello and welcome.

With a Claim Issue Date of 17th June, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 22nd July 2024 to file a Defence.

That's over two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.

To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.

Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

You should never have paid that first claim but I think you know that now. Defending it and seeing it off wouldn't have affected your mortgage.  Would have been easy.

Show us the claim form but cover the claim no, the MCOL password, your data & QR code and the car VRM.

Thank you for the quick responses.

completely understood, however for the first claim it had already went to a CCJ as I hadn’t been back to my property for a while as I was traveling so had to pay it within the 30 days to ensure it didn’t affect my mortgage, but lesson learnt.

The password on the right hasn't been redacted, despite what coupon mad advised 

4 PCNs in total, not 7,  so £400 maximum on those figures, Plus fees etc

Sorry, I was advised on the phone that there were 7 outstanding tickets, so I am expecting more to come I would think.

The original PCNs were £680 + Fees

You must deal with the claim in front of you, for 4 PCNs at £100 each

Sorry where are you getting the £100 each from? on the left hand side I can see £680 for the PCN's not £400.

You are missing the fact that each PCN was for £100 but the parking company have added £70 to each as alleged costs of debt recovery.

Can you remove the pics of the signs because
they aren't UKPC signs, so they aren't relevant at all.

Looks like UKPC were (likely) kicked out due to complaints, probably, as they've been replaced by P4Parking.  If this is your ex-partner's home home car park, are they friendly enough to you now that they'd kindly fish a bit for written info about this change? NOT BY PHONE.

Can your ex-partner kindly email the Managing Agents to tell them about these two claim forms and ask "were UKPC removed due to excessive ticketing of residents and visitors? Were they replaced by P4Parking due to their aggressive actions and refusal to cancel unfair PCNs?"

That will help you later in with your evidence so if there's any possibility put that in motion this Summer - or email them yourself. Ask pressing questions about when/why UKPC were removed.

You know that first claim that went to your old address... did DCB group alert you to it after the event by tracing your new address?

Just wondering if it can be said that UKPC/DCB had your new address in March/April?  Did this NEW claim come to the right address?
