should I download the defence questionnaire myself and send it? As I've not had a response from them nor have they sent me the questionnaire yet.0 -

The CNBC will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
What you don't know is when the CNBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CNBC.
Further, we don't know what delays there are in the CNBC that means they don't send you a Directions Questionnaire as promptly as you might like.
That checklist you were once following states...
YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CNBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CNBC, remembering to send a copy to the Claimant of course?1 -

@KeithP
- I received a half-torn DQ N180 form in the post, called up HMCTS and got them to email me the PDF instead, but it's a new one with new questions.
So I've followed this post and answered accordingly. But how do I reject the mediation on this new form? And obviously the paper form I received is a torn one!https://forums.moneysavingexpert.com/discussion/comment/71763411/#Comment_71763411
Also, the 12 point thread states "DQ N180 must be completed & returned to the claimant and the court" - I can send it to the court, but how do I return it to the claimant? No details of their contact e.g. email address was given?0 -
The one that came in the post, if you can do so , check if its the old form, or the new form
If its the old one, someone on here has provided a download link to download and so you can still fill in the old form using it, not their new pdf
But
If the one in the post is the new one, fill the new one in, the one with mandatory mediation, so you don't get a choice , you cannot reject mediation on the new form
If the Claimant used lawyers, you email a copy to the CNBC in Northampton ( not a court. ) and CC the lawyers too, so everything by email2 -
@Gr1pr
the lawyers UKPC are using are DCB Legal Ltd.
@Coupon-mad
don't suppose you've seen an email address for them? None on their website, only a contact form.0 -
Definitely seen a few on here, do a search
CM is on a well deserved holiday1 -
Update:@Gr1pr - I found the old PDF form using Wayback Machine (incase others are wondering, use same Gov link as the new form and download one from e.g. Oct 2023, Feb 2024 or anything basically before June 2024).
Submitted DQ N180.
Received automated responses from info@dcblegal.co.uk and dpocontact@dcblegal.co.uk so that's done.1 -
@Gr1pr @KeithP @Coupon-mad DCB Legal and have been trying to phone me. Missed it the first time, second time it started with a recorded message which I put the phone down to thinking it's a scam call (was half asleep). If they call again, what do I actually say to them? I've read that they call to settle, but what's actually said in response on the call? If they ask why I won't settle, what's said to them without sounding impolite, saying the wrong thing or risk winding them up which makes them see the hearing through?

Simple, offer £0 , zero pounds . You believe that you owe nothing and are willing to let a judge decide, as shown in your defence statement already
Mention that its a drop hands offer where each party bears their own costs and the lawyers and Claimant login to MCOL and issue a Discontinuance
Don't be drawn into discussing the case, just stick to what I said above, concise, short and sweet, no admissions, no discussions, ZERO pounds, each side walks away, or let a judge decide
