    I have emailed my amended defence to civil.torquayandnewtonabbot.countycourt@justice.gov.uk

    I received no confirmation reply and the deadline is 4pm today.

    Is email an accepted way to file it with them?

    Yep. It might not send out automated replies. Double check the email spelling because it's a silly one though.

    Allocated to the small claims track now and hearing 5th March. Was hoping that would be the end of it but not to be. At least they have to pay the hearing fee to continue.

    The warning in this letter makes me slightly curious. Could it be he wants to shellack them for missing mediation as raised in my defence (or is that wishful thinking).

    What is the important thing to include in the WS, as to me everything is covered by my defence doc?

    I don't have a "story" to rely on, my defence is that Gladstones have not shown evidence of a contract since the only sign they've put in their claim does not mention any charges.

    Also the email screenshots I put in my defence showing that they rescheduled the mediation twice and missed the actual mediation appointment.

    If you fail to follow court directions & do a WS and evidence bundle, then you won't be a witness. Technically you'd have no right to speak at all.

    Your witness statement backs up and supports what you wrote in your defence; you must also provide evidence at this stage, so those screenshots and the signs will be important.  The witness statement is a narrative (story) of what happened on the day and subsequently.  How did you manage to have mediation before you submitted your defence?

    It was because the judge struck out the claim and gave Gladstones the ability to produce a new (valid) claim. This gave me the right to produce a new defence that was after mediation.
