    so I would not have got JSA anyway, cos I work above the JSA limits, so I just check the UC statement matches and if it does, leave it like that.

    Not if your earnings are more than £95.50/week.

     if we get nil one month, we leave it like that and let it run until.eg the next month our wages go down and it gives award again automatically.

    I also think I'm going to go on emergency tax , till P45 is received ,then get correct proper earnings in future months, I don't want the DWP to miss understand .and give too much one month and too little the next month cos if this emergency tax code is fixed and I got all my emergency tax reimbursed


    There won't be any misunderstandings because as we keep advising, UC entitlement is based on earnings received during your assessment period, which is 8th to 7th of every month. 

    If at some point in the future you do receive a tax rebate then you must report that to UC and it will be treated as earnings and affect your UC in the assessment period in which you receive it. 


    I also fail to understand how you can get sanctions on dropping hours when you make a  fresh JSA claim BUT no sanctions when you make a fresh UC claim as it was never asked in UC  form, even tho in a JSA and a UC claim there is a  claimer commitment, it says look for work( if applicable)., where as eg  the fresh JSA claim guy gets sanctioned and the fresh  UC claim guy doesn't, cos UC form isn't asking anything about previous jobs and why you left, or dropped hours, when applying., but the JSA form is 
    There can be sanctions to UC if you reduced your hours without good reason. At some point they will be asking what your earnings were in the past 12 months, this is related to the benefit cap grace period.

    benefit cap grace period, how does that effect me, I've worked mostly low full-time ( 30 hrs) in last 12 months, and extra full-time if that phrase exists.( 57 hours) in different jobs 

    I gave up my last job cos the contract states 35 hours a week, but from day one I've been doing 57 hours spread over a 75 hour shift week. 5 day week 

    I complained to employer who said we guarantee 35;hours but we can make you work overtime, and we dont guarantee the min length of the shift( even tho at job interview I was told shift will never be spread over more than  12 hours and 9 hours will be the norm.,  employees will burn out and resign if this is not the case, said the area manager that interviewed me )( he resigned after 5 months himself, his shifts were as bad as mines)!

    they burnt me out!

    I also said to employer I legally need 11 hrs off between shifts, you are giving me  8 or 9, they said as your day is a spread over 15 or 16 hrs with multiple small breaks, we are within the law.

    so you will have to work what we say and when we say .it got to the point I was mentally and physically exhausted, I was living on 4 to 5 hours sleep between shifts after getting home, feed, washed ,watered etc.

    but I never went to doctors, I hate doctors, and still on my 2 year get rid of you period ,so I took the part time job and left old employer , I'm starting to feel my old self again, be it slowly.

    ps i asked manager at interview why vacancy in first place, they said previous employee was off sick too much, so they got rid of her. I later found out they made  her work a spread over from 5 am to 11pm   and she walked out

    I never implied it would affect you, it won't. What I said was they will ask for your earnings figures. This is to check whether it does apply or not so they will know from that, that you've reduced your hours.

    I don't understand what benefit  cap grace is, that's why I'm asking, thanks 

    so I will not have to explain why I went from full-time to part time 

    surely they will know that I've reduced hours when they see next month's earnings, cos it's only part time 

    I've probably earned £23000  net in last 12 months  or £40000 combined with wife.

    well I have very good reason as I explained in my previous post , would you agree?

    and they can see all my earnings for 12 months in P45s they got, as it has the earnings for each job, they don't need me to start adding up wage slips etc

    Whether it is or not, is not for me to decide, that will be down to a decision maker. The 12 months earnings will appear in your to do list and you must fill it in.

    does that mean I have to dig through pay slips and get a calculator out, what if I don't add it up right, surely they will know via the p45s they got sent , they will know the totals

    P45's relate ro a tax year. 
    If they want the last twelve calendar months then you're going to have to look at payslips or use the Government gateway which will show your earnings as reported by your employer(s)

    Just double check your workings, ask your wife to check it too if you're not too confident.

    I am confident, and I use government gateway, just wondering if they come down hard on folk that make a mistake with their adding up.
    surely it's the job of the DWP to add up.

    I'm starting to realise why folk don't make claims for benefits and so much goes unclaimed,it's like it'll come the point in future where there are no DWP staff and it's all computer
