... The gist of his ACTUAL complaint is that he asked if cam belt had been replaced.  I said yes,  because when I bought the van this was what I asked and was told yes...
Can I ask what you actually told him?

Did you simply say "Yes" or did you say "Well when I bought it I was assured that the cam belt had been changed"?
[12:50 pm, 20/05/2024] Ady: Forgot to ask has the cam belt been done recently
[1:25 pm, 20/05/2024] Mandy: Yes but, I've just sold it now

This was the whole Cam belt conversation, another lady was interested at this time but due to her disability she needed a reversing camera so changed her mind.

He did not ask for the date it was done or if there was a receipt, He had well over a week to ask for more information.  I did not ask the guy I bought it off these questions either so all I knew was that it had been done before I owned it which was for 3 years.

Just a wee point. I have read this thread as it becomes updated. Has anyone considered that the guy wanting his money back may have access to this forum and may have been reading all the posts and advice offered which could let him know what your plans are. It's something to bear in mind.

It is possible as he stalked all my Facebook posts, but he is getting free legal advice from his company and I have sought help from this place being a pensioner. I haven't written anything that isn't true on here.

Unfortunately nothing can be done about that, but no-one here has suggested the OP does anything less than above board so there's no gotcha to be found by the buyer presenting screen shots in court.

Sorry, but I don't understand your response to my question...

When he asked whether the cam belt had been changed recently, did you basically say (1) "Yes it has" or did you say (2) "When I bought it I asked the same question and was told it had been changed"?

Do you see the difference between (1) which implies that you know it had been changed, and (2) which is what you actually did know?  ie that you'd been told it had been changed but didn't know for sure if it had or not.

I don't understand your answer:  "Yes but, I've just sold it now".

Who were you saying that to?  What has the disabled lady and your responses to her questions got to do with with the sale to your buyer/the claimant?

So when asked if it had been done "recently", you said "yes", even though you knew it was at least three years ago - not sure that would be what's intended or understood by 'recently', despite the age of the vehicle?

I'm struggling to square this being the whole conversation when you'd previously described it as:

I am honest and when they did ask about the cam belt I said it was done by previous owner not myself.
I'm not trying to catch you out here but if this is the pivotal issue to be resolved in court, it's crucial to have your story straight, in that apparent anomalies will be spotted and exploited....

Before you do anything, head over to the parking sub forum

    https://forums.moneysavingexpert.com/categories/parking-tickets-fines-parking

They deal with small claims all the time, against parking companies, but the process is the same and described on the newbies thread.  They say don't fill in your defence online, leave it blank as it can't be changed after.  Once acknowledged , you have plenty of time to file a defence and your witness statement.  Although not parking, there are a lot of knowledgeable people over there who I'm sure can assist if you get stuck.

On 20th May buyer ask the question below on WhatsApp

Forgot to ask has the cam belt been done recently
[1:25 pm, 20/05/2024] Mandy: Yes but, I've just sold it now.

My reply reply was simply yes, but I've just sold it.  (A lady had agreed to buy but changed her mind as she needed a reversing camera due to disability) hence my saying it was sold at this point.

There was no more discussion or mention of the cam belt whatsoever until the day after he bought it which was 29th May.

The day he bought it he spent some time going through the A4 folder of receipts, I left him in the van while he looked through them as I had to take my dog for a walk round the carpark we were in as she needed a wee.
He could have asked further questions at the time but he didn't.

I have driven it exactly 12,390 miles in 3 years, as the previous owner said he'd done the cam belt and only had the vehicle around a year it did not require changing in my ownership.

But by your own admission that folder of receipts was over two inches thick, so I'm not sure that too much reliance can be placed on failing to pick up on something within it (or not there, according to him) during a quick readthrough on the day?
