    You must ask for the previous address to be "erased". Requesting "removal" is not the nomenclature that is used. It is important form a legal aspect.

    An email from DCB:

    Dear XXX,

    We write in response to your correspondence received in our office dated 06/06/2024. 

    We now respond to the same as follows.

    The HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that parking charge notices falls out of the scope of VAT. There is no requirement for a VAT invoice to be issued to you.

    The amount owed is a genuine pre-estimate of the losses incurred in managing the parking location to ensure compliance with the clearly displayed terms and conditions.

    The sum added is a contribution to the actual costs incurred by our client as a result of your non-payment. Our client’s employees have spent time and material attempting to recover the debt. This is not our client’s usual business, and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.

    In accordance with the British Parking Association (“BPA”) Code of Practice, where the Parking Charge Notice (“PCN”) becomes overdue and before Court proceedings have commenced, a reasonable sum may be added for the debt recovery fees.
    BPA - 24.1b “Where a Parking Charge becomes overdue and before Court Proceedings have commenced, a reasonable sum (which covers the cost of recovering debt) may be added for the debt recovery fees. This sum must not exceed £70 unless prior approval from the BPA has been granted”. The correct recovery fees have been added and will not be removed.

    You now have 30 days from the date of this email to pay the outstanding balance of £170.00.

    Failure to do so will result in a claim being issued against you without further notice.

    You must quote the correct case reference () when making payment. If you do not, we may be unable to correctly allocate the payment. If further action is taken by us as a result of an incorrect reference being quoted, you will be liable for any further fees or costs incurred.

    No answer about the question asked concerning VAT on the admin/debt recovery fee, just quietly brushed it under the carpet.

    Reading the thread, it seems like the next move is to wait for the claim form to arrive since I already responded to the letter and the email they sent is simply reiterating their stance.  In the meantime, we report for VAT fraud as per the link on the bottom of page 3.

    Suspected VAT concerns.  We don't know for sure but HMRC need to follow the money and consider the true meaning of 'PCN' and the true object or effect of the third party DRA fee.

    Howdy, so this one took an interesting (and potentially problematic) route.

    My sister in law is a worrier, and with the nastygrams that were going back and forth, she spoke to her partners father who works at the Screwfix in question. In turn, he spoke to his manager who spoke to someone else etc etc, but the upshot of it was that the manager would get it removed, so I stood down on this.

    Now, fast forward to a week ago, the attached was received.  The problem is that my sister-in-law has since fallen very ill and is in hospital with pneumonia.  Cut a long story short, this is why I now only have 3 days to appeal this letter, and not the luxury of 10.

    If I'm reading the thread on NEWBIES correctly, its says next stage is to do the online response to the summons, which I'm not sure this is?

    Any help would be much appreciated as the clock is ticking, and I've only been handed this today, so I've been caught on the hop.

    Which address has this been sent to as it is for failure to pay a fine through the magistrates court not a parking civil court judgement.  Maybe a motoring offence whilst the car was registered elsewhere.
