Esst Midlands Airport-Civil National Business Centre Letter- Elm Legal- Vehicle Control Services

Hi Looking for some help on my next action.

I've received a Claim Form from The Civil National Business Centre from Vehicle Control Services.

Its for Breach of Contract Claim from Vehicle Control Services, being handled by Elms Legal Limited.

It relates to a breach of advertised terms and Conditions in a Stopping Zone at East Midlands Airport. It seems based on seeing a sign on entrance to the the airport were clearly diplayed.

It states a date of the breach (November 2023), though no time or specific place. I am the legal keeper of the vehicle registration.

They are looking to recover the cost of a parking Charge Notice £170, Court Fee of £35 and Legal Costs of £50.

Looks like I want to dispute the claim and should Sign an Acknowledgement of Service.

It says I can contest juritstiction of the court...though not sure what this means.

It also looks I can defiend the claim and ask for additional time by going to www.moneyclaim.gov.uk

    What is the Issue Date on your Claim Form?

    Can you please show us the Particulars of Claim from your Claim Form - hide all personal data of course.

    The claim is for £170, £30 court fee and £50 legal representatives costs. Info was useful and understood that best thing to do was to go to court to explain the situation.

    With a Claim Issue Date of 29th May, you have until Monday 17th June to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 1st July 2024 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Yes I know the reason and was for no more than 3 minutes to look at phone map > stopped off main road. There is proof that it was a mistaken address for DHL at the airport and had got lost. On Airport for no more that 15mins total. Never went anywhere near terminal. Have proof of time when a package was picked up from correct address further along road.

    You might want to read this EMA case where a poster succeeded in a counterclaim, and reportedly:  "The Judge advised VCS solicitor the Bylaw is there to protect the public from firms like you."
