Contesting Parking Ticket after Court Judgement

  • Hi everyone,

    So it looks like the name and address details were all correct. Just a slight discrepancy as missed the (A) after our building number. 

    Other details are; the ticket was initially issued on 28th November 2022, at Wembley Stadium Retail park. The representative also said the claim form was sent on 20th November 2023, and the judgement was issued on 26 March 2024, which has confused me. 
    The only letters I got rid of were the DWLegal ones, as I found them overwhelming. So I found this confusing that the judgment would be issued 5 months after the claim form was sent, which I honestly don't remember receiving. 

    He said I only had 2 options 
    - Pay the amount, as i had missed the claim form date
    - Contest it, however he told me there wasn't much point as the balance stood at £277 and the application costs £303

    I'm gutted and cross at myself because this has honestly affected my credit score.

    Option 1 , payment in full , won't remove it, it stays on the system for the next 6 years, affecting your credit 

    Option 2,  is the one that removes it, if successful, but they should have mentioned that option 2 has 2 methods, one costing about £110 and that other one being £303 , with no guarantees of success

    I have no legal training, but missing out the A in building A seems reasonable to me, simply because you stated that the claim form pack was never received 

    Please confirm that your V5c has the exact and correct details, including that A

    The CNBC staff should NOT be misleading you like that.  It isn't their place to say that.

    It is also COMPLETELY WRONG for the CNBC staff to say there is "no point" applying to set aside a CCJ (and wipe it completely if you succeed) given the alternative - paying it now - DOESN'T wipe it, and leaves it (marked 'satisfied') damaging your credit for 6 years. 

    What were these circumstances? Was anyone in the car that day disabled / pregnant / breastfeeding a baby under 6 months old?

  • @Gr1pr I'm going to try find the paperwork as we sold the car earlier this year. 

    @Coupon-mad It was a genuine mistake on my part, I went to help/ take care of my sister (pregnant at the time) with a 2 year old, who lived in the area at the time (of which I can provide proof). Hadn't realised I'd overstayed, of course all too late at the time. 
    I found his advice on this really disheartening and it was almost like 'you can't do anything about it' attitude. I'll try appealing and since it would stay on my credit history for 6 years, I may as well try.

    @Gr1pr I've checked the V5C and it has all the correct details, so they've definitely missed the 'A' out in our building number which probably means it was delivered to another house on the street, with the same number.

    I've had a read through your CCJ section, I've realised I can apply for the help with court fees as I'm not earning enough with 2 children. So I'd fill in forms N244 and EX160..? Hopefully I've understood that correctly. Also I'd have to write up my own witness statement, as in this posters thread.. is that right?

    The EX160 is the correct form for help with fees.  Did you read the NEWBIE sticky second post, the section about CCJs?  There are several examples of witness statements: -
    A recent October 2023 completed thread, ending with the parking CCJ set aside, PCN cancelled/claim dismissed - and all their costs back - is by @Troublesum1 (that is a link).

    Here's a 2023 'CCJ set aside' example where the Judge ordered for the Claimant (PPC) to pay the £275 fee back and the whole claim was dismissed in a single 15 minute hearing:
