Phone the court on Friday and check if they paid the hearing fee or not

Meanwhile,  keep checking your inbox and spam folders for their N279 discontinuations document attachment,  same as in hundreds of other cases on here

The drivers WS should tell the story, their contribution,  but must be truthful

You must prepare one anyway,  regardless,  if they pay the fee on Thursday

Thank you - I rechecked and the deadline for them to pay the trial fee was yesterday, so I called the court today and was told that they can not see any fee paid on their system.

Also - I was told over the phone that the hearing set for 26 Nov is now moved to 3 December - but I did not receive any correspondence to inform me about the change of dates and no NoD in my email or spam.

Please what do I do? do I write to the court to send me details of the new hearing date?
many thanks for all your help as always

so I phoned the court yesterday(monday) and today and was told that NO trial fee has been registered on their system. Note: the deadline for payment was 29th oct

I have been constatly checking my email and Spam for any notice of discontinuance but nothing at all yet.

the deadline for submiting my WS is 10 Nov.

shall I keep checking or just submit the WS before due date? just not sure what to do in the meantime

Would the hearing fees due date change with the hearing date changing from Nov 26 to 3rd Dec?

You would have to ask the court, its all down to their local practices,  in other words, we dont know because you haven't received a new court order with the new deadline or deadlines

I would suggest submitting it next monday,  to court and to the lawyers too, assuming that it's going ahead, UNLESS you receive a discontinuation or a new court order from your local civil court. You must follow the process UNLESS you receive written instructions or a discontinuation or you are told that the hearing has been vacated

It's a game of chicken remember. They could stretch it out until the 9th.

Submitting a witness statement early and applying for costs when DCB discontinue at an unreasonably late stage is a tactic in itself for defendants.

    Thank you very much All
I just phoned the court again the morning and was told that a notice of discontinuance has been uploaded for my claim, however, I have still not received any emails from DCBLegal.

please what do you advise I do?

Their emails can go to your junk folder so check there or email DCB Legal ask for copy of NOD.
When it's received remember to post image of it here. Umkomaas needs to see the NOD to add you to his discontinuance thread.
    👏 Well done.

Email DCB Legal and ask for a copy of the signed NoD, or you'll attend the hearing anyway & claim all your costs. That should get it next week.

Please show us the NoD when you get it (not the email body)! You could be no 700 discontinuance in @Umkomaas' thread.
