It's unlikely you'll get your credit back. (How have you managed to build up £130 of credit on a prepay service)
The suggestion is normally to use up any excess credit.

You know full well what contract means in terms of a phone, as opposed to forming a contract.I believe mark_d to be incorrect. When you make a payment to a pre-pay provider you are entering into a contract to purchase a specific amount of airtime or airtime credit. You are not adding funds to an account that are then used up and neither are they offering a short term credit to cover the cost of your activity on the network. The prepay providers can’t do that because they would need to be FCA Authorised as the postpaid providers are. There is therefore no money to refund. That’s not to say that a provider can’t choose to pay you something as a GOGW but they are under no obligation to. If there was then other things that work in the same way (gift vouchers, download codes, public transport multi-tickets) would also not be feasible.0

I am new to 1p mobile, my 90 day period came to an end on 30th May so I topped up on the 30th with the £10 top up.
Today I received an email saying that my remaining credit had been taken and that as i now only had £9.99 credit I needed to top up £10. I didn't even have my phone on yesterday so couldn't have incurred any charges.
It seems to me that I should have waited for the 90 day period to expire. Would be interested to know if anyone else has fallen foul of this term.
Will try and contact today to see if they can be reasonable about this misunderstanding
EDIT
Wasn't aware of the new terms and conditions i.e. minimum spend of £10 in the period (was 4 months and no minimum spend, when I joined end of Feb).
Told I only have to make sure that I top up before the end of the 90days so that I have "spent" £10. The email sent however to top up now.0 -

The suggestion is normally to use up any excess credit. It is not a monthly mobile contract that many people have in general, but it is still a contract based on the legal definition of contract. Even it is just an oral not even a written contract, it is still a contract, an oral contract. The only problem with the oral contract is, it is very difficult to prove it if the third party needs to make a judgement.https://uk.practicallaw.thomsonreuters.com/4-107-6271?transitionType=Default&contextData=(sc.Default)&firstPage=true"A contract is a legally binding promise (written or oral) by one party to fulfil an obligation to another party in return for consideration. A basic binding contract must comprise four key elements: offer, acceptance, consideration and intent to create legal relations."These four elements: "offer, acceptance, consideration and intent to create legal relations" are already fulfilled in 1p Mobile case. The TCs is difference with the general contract between two individuals as in the TCs is the terms use of a sale of product and services in a the broad agreement between the two parties. Any TCs is outlining a contractual relationship. By having a TCs a person already have a contract with the service provider. The main point with the 1p here is that they unilaterally change the TCs without giving people a choice to exit, taking people money and mobile number as a ransom. In other areas such as fibre Internet, ISP you have the choice to quit the provider without penalty in such case.0 -
I am also rather annoyed by the change in the Ts & Cs. I can't recall seeing any warning they were doing this. They've docked £9.41 from my balance. I've put in a complaint. I will be using up my balance on data bundles (instead of my normal PAYG Lebara one) and switching to RWG from 1p as soon as that's gone

Glad i picked RWG instead.

Here, we only get a weak EE signal, but even that is not reliable. for over a week now we have had no EE signal at home (keep getting emails to tell me the fault is fixed, followed by another to say the fault is taking longer than expected)
So my 1P Mobile phone still works, because wifi calling works. My RWG phone is a brick at home because there is no wifi calling on that.0 -

Credit never expires,as long as i make a call or send a text once every 3 monthsIt was like that before they change the TCs. Do not get anywhere near. there are currently a lot of better deal out there. With this change, it is effectively equivalent to £3.33 monthly contract but with such an inferior deal for data. With 1p/per MB so 333MB for £3.33 ??? It is an insult to people intelligent. They are using one of the oldest scam on earth, "advance fee" taking people money and phone number as a ransom for such an inferior deal.0 -
