ZZPS,
Stop misleading me about my right to appeal and legal liability.
Due to PoFA 2012 if driver details are not provided within 28 days of the initial correspondence the keeper can be held liable. ONLY if the parking operator has served a compliant NTK by day 56.
You and your client are also in clear breach of the BPA CoP paragraph 24.4. No NTK. No reminder or liability notices. I believe ZZPS did the back office work in this case so this is your own fault.
You dropped the ball on the required notices. Threatograms don't cut it. Jog on. You lot couldn't progress a p**s up in a brewery.
Yours faithfully

Finally, I've had the QDR Solutions email asking me to complete the "security questions". Oddly, nothing about the context or reasons why I'm getting the email other than "important documents are waiting for you". I plan to ignore this.

Hi All - So I've received the debt collection from DCBL 2 weeks ago. As per the guidance, ignoring this until a formal claim is submitted.4

Hi All - it's been a while but after few more debt collection letters, I now have received the court claim form from GBP Management. I've attached the pictures within.
Oddly, It mentions I was the driver of the vehicle appealed as the keeper.
In terms of next steps, I should log onto MCOL on the 02/09 (5 days after the Issue date) and advise "I disagree with the claim". I can then use the defence template within the 28 days of the issue date.
I appreciate everyone helping on this so far. Thank you

Aos on Tuesday or later
Your deadline date is then 4pm, 33 days later than the issue date, which is 28 days after the service date
Use the template defence by coupon mad, adapt paragraph 3 to address the POC, same as all the other recent dcb legal cases
Please edit your out of date thread title to something more suitable like

So I've the following response from the company in question and wanted your help to draft a response to it. I've had a search on the forum where they are advising the PoFA 2012 means keep is liable? Your help on this is greatly appreciated.
Thanks,Good afternoon,Thank you for your email. Please be advised, if driver details are not provided due to PoFA 2012.The Keeper will remain liable for the charge. Please also note, we have not sent any direct contact to the keeper of the vehicle at this time, our client has only placed a ticket on the vehicle on the day of the contravention.Fruitcake said:Ignore it and wait for the NTK whilst of course still pursuing Plan A, complaints from the keeper to the landowner and the keeper's MP.Umkomaas said:poshMosh said:I've just had the first correspondence come through including several texts to get in touch with ZZPS (24th June which is 81 days after the incident date):
Should I reply back to my original email to obtain POPLA code?
2. Did you receive a rejection letter? If so ..
3. Did it contain your POPLA Verification Code?
If 2 and/or 3 above are negative, then you must firstly complain to GB Mgt demanding a POPLA code, with 7 day deadline, otherwise, you tell them that you will complain further to the BPA.Ignore ZZPS - debt collectors (see NEWBIES FAQ Announcement, fourth post).poshMosh said:Thanks for the response. Couple of answers to your points:
1. I appealed and they rejected
2. Rejection letter stated driver details are to be provided due to PoFa 2012
3. Not yet - my plan is to reply back to the email asking for the POPLA verification code and also complain formally.

Did they ever post a Notice to Keeper? Show us both sides of that, too. But I think they didn't even send one?
They aren't very good at this are they!
ZZPS calling the shots, no NTK at all despite the driver not being identified, then ZZPS repeatedly lying to you about the POFA and liability, refusing to issue a POPLA Code, then suing the keeper knowing full well no POFA paperwork was ever served!
I will be so happy if and when ZZPS & DCB group end up banned in the end.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
