    You are not going to be influenced by the £50 bribe, so stop looking at that!

    Isn't the winning POPLA appeal point about cropped images with no time or date-stamp, relevant because IIRC the Assessor was saying the VRM close ups are cropped and undated? Not the pics of the car.


    I really don't want to but due to the issues I have at the moment even typing these sentences is causing my wrists to burn in pain, I just don't want to draw it out long term if it is unrealistic that I have a chance at winning. Trust me I hate these companies more than most.

    I used to work in retail almost a decade ago, a Currys store and customers would come to me complaining about the parking notices they received from ParkingEye. I wouldn't even get a manager involved or ask any questions from the customer as I knew the email address to use and could just easily send off a sentence or two to get the notice cancelled. I must have cancelled dozens in my times there and I didn't even work in customer services just helped there when they were short of staff. Parking eye even sent me a few notices back then but as an employee it was easy to sort.

    By the way, when I say I worked at Currys, please don't think I was one of those that would sell you all the unnecessary add-ons, I treated all my customers as I would want to be treated myself and I never sold anything to a customer that I didn't think they wanted, that's why my sales performance for the "extras" was terrible and they would constantly pull me up on that. The only thing I had going for me was that I was trustworthy and really actually knew a lot about the technology sold there unlike most others they hired.  

    I just hope my experience at Sainsbury's tomorrow is as simple.

    Regarding the cropped images I am not sure what they mean, but will look into it. 4 images are included, 2 images show the front of my car only up to the bonnet and under each image is a further cropped image of number plate from the image. All images have date and timestamps in the top right corners of the image but are difficult to read as they are tiny. There is a larger date and time printed above the entry and exit images though. I can post the images here if it will help?

    Ahh okay, well I'm SOL on that one, the bottom images on mine also have timestamps as well as the top images. And they're the exact same size and exact same layout as above.

    I'll be visiting the store in person first thing tomorrow morning, by public transport and will try my best to make a good argument stating that I'm a long time regular customer and that I did a shop on the day, otherwise if I fail, I'll just have to chalk it up to experience as I'd only have a day to get a response from the CEO thanks to the scum at ECP.  :'(

    I'm still not understanding why, if you don't get the right response tomorrow, you feel the need to pay anybody anything.

    Yes I understand the amount allegedly owed goes up, but doesn't that make your resolve to pay nothing even stronger?

    I've spent many hours reading and am still not that clued up on all of this but I don't want to try and fight something that may snowball in cost and lead to a court case.
    After reading through the successful appeals thread I just don't see anything that will apply to my case so the if trying to get Sainsbury's to cancel it doesn't work, and I can't successfully appeal, I don't think I will stand much of chance winning this in court. It's just extremely annoying that it seems as though ECP have got me bang to rights based on their letter. 

    I have heard of people ignoring these but I'm not sure if that still works either. I just don't see any other way out. And thanks to my luck PePiPoo is not around any longer either. They helped a lot when it came to an old box junction PCN I got many years ago but the site is down and most of it is not indexed on the Wayback machine either.

    It doesn't snowball in cost in the way I think you are fearing.  ECP hardly ever litigate and for an £85 PCN, the amount claimable would be under £200 (including court fees) and that's only if you lost.

    Don't pay.

    So I have read through the stickied thread going from most recent posts backwards to August 2023 and am still unsure of the winning points.
    You need to go further back. Start at page 416, then work forward from there. Look for the winning appeals relating to ECP signage not showing the £100 charge sufficiently prominently.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I promise I will, I'll take a little break but will then read from page 416 onwards. I will also photograph the signs around the car park tomorrow and post them here. I already have a photo of the signs from 5 months ago but haven't taken a photo recently.

    Take any photos which display the parking charge a bit less prominently than the one above. Make sure the photos are time stamped (there's an app you can get to do that, check via Google).

    I just noticed that the sign says charges apply from 08:00 to 17:00.
    I left the car park at around 17:17, so does that mean I actually only stayed for 2 hours and 8 minutes during the charged hours? Does this change anything?
