I think you are dealing with kiddies over at Costa and I'd be surprised if they realise that it is now at court stage. Perhaps tell whoever sent you that to make sure a responsible adult is involved in the process at this stage.

The Cabbage Patch wokerati at Costa don't even understand that it isn't a "fine" of any sort and almost certainly have no idea that is now well above what they imagine is a "fine" for ~£100. They also fail to comprehend that if they simply let it run to a hearing and the claim was defended unsuccessfully, they would likely have to pay less than the claim amount.

I'd double check that whoever sent you that letter is aware of the process and the actual amount now being claimed. Without the amount being specified in their letter, they could turn around and claim that they were unaware that the amount was what is now being requested as reimbursement.

I have some good news! Costa Coffee emailed me the following:

Thank you for sending over the documents and for your continued patience during this process.

Given how close the court date is, we are prepared to cover the fine. You will need to pay the fine directly, and once you have done so, please provide us with a copy of the invoice or receipt, and we will reimburse you promptly.

We are still investigating who made the original agreement with the parking provider so that we can make the necessary amendments moving forward.  We will of course update you on our progress.

What do we think about this? I believe the full court claim is £237.50. Should I contact CEL and agree to pay them the full amount and then get a reimbursement from Costa?

    Dear xxxxx

Thankyou for offering to pay and I accept your offer (if I lose in court I will email you proof of paying so I can be reimbursed for any loss and extreme harassment).

    But I think you misunderstand.

There is no 'fine' (these scam charges are not penalties or fines) and the hearing is imminent with £237.50 plus a £37 hearing fee already paid by the ex-clampers.

Given the fact that, if I lose at the hearing, the sum ordered by the Judge is almost certainly be LESS than £270, it would be madness for me to pay it now.

And I expect to win but will update you either way and will accept your reimbursement.

I sincerely hope your management team are going to end this aggressive ticketing/suing contract as soon as it expires because this is affecting your repeat custom and reputation.

This isn't how to treat customers and paying the damn thing (so close to a hearing, where I expect to win or pay less than the claim) is just sponsoring the regime you should be dropping like a hot potato.

Wrong move. Sort it out please.

    yours sincerely
