Court papers issued for UKPC

Hi and thanks in advance for the helpful information on this site. A lot of hard work clearly goes into this.

Basically I’ve read the newbie section and read a number of posts from different claims however am still a little unsure as to what/where/which case I need to take my defence from.

Effectively I stayed for 2hrs 14mins in a 2 hour max stay free car park. Is there a case that aligns well with this I could be directed to?

i have submitted my acknowledgement of service and have a little over 2 weeks left to file my defence. 

Any help would be greatly appreciated.

    Yes - you just use the Template Defence.

    Show us the Particulars of Claim and tell us the Date of Issue of the claim form.

    Is it a claim by UKPC in-house or DCB Legal?

    Date of issue is the 5th April. The claimant is UK parking control limited however it states under the ‘address for sending documents and payment’ that it is DCB legal Ltd.

    Date of issue is the 5th April.

    With a Claim Issue Date of 5th April, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 8th May 2024 to file your Defence.

    As you say, that's over two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Thanks. So it seems as though I need to write my own paragraph 3 to state what happened however I’m not sure what to focus on here? I’ve parked for 2 hours as per the free parking allowance. I’ve effectively looked at the time after I've parked and exited the car and started towards the shop and taken a mental snapshot of the time. Obviously that’s not the same time as the ANPR camera has picked me up. I’ve then returned to my car 2 hours later - potentially taken longer to get in my car and exit the car park as I have a (at the point) 15 month old baby. The end result is a 14 minute overstay. Am I literally stating this in my defence?

    Why not just read some other claim threads?  Every other thread is the same. Copy...

    Paragraph 3 is specific to me though isn’t it. Thats the bit I’m struggling with.The rest I can copy as you say. I’ll type out my defence later and post it here. Thanks 🙏🏻

    Please just post the paragraphs you add or amend; we do not need to check the whole template!  ANPR captures time in versus time out, which is not time parked, there is/should be, consideration time (for reading the t&c's) and grace period, to exit the car park after leaving your spot; was it very busy that day, queues at tills............
