    It's betterment as you (or the tenants) have had 2 years use of it. Hard to quantify though - how long is a loo seat (of that quality)likely/expected to last under normal circumstances.
    Personally I'd just replace it along with other minor between-tenancy maintenance works.

    Make your claim, let the tenant dispute it, and see what the deposit protection scheme says. Best case you get a deduction equivalent to the cost of a 2 year old toilet seat, not a brand new one.

    But no picture? Is it bad enough that you will have to replace it, even if you can't deduct the £35?
    I always replace at start of new tenancy
    So, no actual loss then?

    this is exactly what I thought. But I didn't know what TDS would say re betterment etc

    because they damaged it 
    But they haven't caused you any loss, because you were going to buy a new one anyway. Goodness knows why you do that though.
