OK, but not the driver. So IfI write "use portal" am I admitting to be the driver? and at this stage does it matter. I wasn't the driver at it happens.

Are you not going to follow this suggestion?...
Just use the portal to reply using the Template LBC response.  Do not expect a sensible reply from the solicitor.  They won't stop.

    Yes, I wanted to check.
I'm going to use the complaints@bwlegal.co.uk if I can't get the portal to load and hope they get it.

Solicitors signing with their company name is completely normal.

Concentrate on your health. Don't worry about a typo in your DOB.

Come back if you get an answer to your email or a court claim to defend.

    Dear Mr. X

Thank you for contacting us, please find our response below:

    Good Afternoon,

    Thank you for your correspondence.

Debt recovery costs are contractually agreed by the motorist when visiting the car park.  They only apply when the opportunity to pay the parking charge has expired and the parking company has been forced to commence debt recovery activities.  Such contractual costs are recognised by the courts as covering debt recovery activity between the expiry of the parking charge notice and the commencement of litigation, including pre-litigation correspondence.

The fees we charge our clients for our services are subject to VAT.  However, these are separate and distinct from contractual debt recovery costs recoverable by our client from the motorist.

If you would like to set an affordable repayment plan, then please make us aware.

If you have any further issues or new questions that you would like us to assist you with, we kindly request that you use the contact options below to submit a new query.

    Yours sincerely,

    BW Legal

This response is sent from a NO REPLY email address.

Obviously, the next step is to report BW Legal to HMRC for VAT concerns, as you will have seen in every other BW Legal thread (we sincerely hope you are reading other threads to learn from them...).

That was the whole point of you asking the question about VAT: you were awaiting their reply so that you can now report them to HMRC for pretending that the added £70 isn't a debt recovery fee (it is: three months ago BW Legal were calling it "our costs").

    Search the forum for:

BW Legal VAT concerns our costs

Copy what other posters did. Takes 10 minutes & the complaint is anonymised by HMRC who won't tell BW Legal who raised the concern.
