    Good Afternoon,  

     

    Thank you for your email, the contents of which have been noted.  

     

    Due to a change in the Civil Procedure Rules, Mediation is now mandatory for Small Claims issued after 22nd May 2024 (except for those issued by the Online Civil Money Claims portal). We are therefore unable to cancel your mediation appointment. 

      

    The scheduled appointment will go ahead during the time/date offered. If the mediator cannot contact you, your appointment will be cancelled and if not already done so the claim will be transferred to a local county court to be listed for a hearing.   If you do not attend the appointment, the judge will take this into consideration at any court hearing and may issue a penalty. This could include the judge automatically ruling in the other party’s favour or ordering you to pay for some or all the other party’s costs.

    Replied to the Mediation: that I wouldn't be in the country and that I hadn't heard from them on the official complaint.

    You MUST ATTEND even if abroad. It's a phone call and you MUST answer it even if you merely say thanks but you are - on principle and based in the appallingly weak claim as pleaded - not prepared to offer money to a parking scammer.

    You are allowed to say that to a Mediator. They need to hear this from people consistently, so they feed back that Mediation isn't suitable for parking scam claims.

    Do not feel pressured make an offer.

    BUT YOU MUST TAKE PART.

    An update: The mediator backed off and received a letter with an allocation to the Court.

    An update: I received a letter from the court asking me to provide the claim form and defendant's direction questionnaire. so to my understanding its N180 form with the defence that I wrote to them?

    Correct, a common theme over the last few months, missing documents 

    You should email that local civil court with a copy of the claim form, a copy of the adapted defence pdf that you submitted to the CNBC,plus a copy of your submitted N180 DQ too, so again the one that you submitted to the CNBC, so they have copies of all 3 documents  ( claim form, defence, N180 ) , belt and braces 

    Add your name and the claim reference number

    Are you SURE the order requires you to send the 'claim form'? That isn't your defence.

    Are you SURE the order requires you to send the 'claim form'? That isn't your defence.

    Show us a pic of the order (data redacted).
    Additionally, I received a phone call from DCB legal; Which they wanted to talk to me and the court. I refused to talk to them.

    Just send her a copy of the N180 DQ you sent to the CNBC. The claim form is the responsibility of the claimant to send. Let them go through the hassle.
