    No it's looking fine. No time has elapsed.

    The CNBC will set aside the CCJ because they lost your defence. Their fault. Happens all too often and everyone gets it set aside (and compensation).

    Thank you, that gives me some hope, I have complained to the CNBC, so I wait with bated breath.

    Hi, just to update here so others may find hope, my judgement has been set aside, but it still may go through the courts again if the claimant wishes to pursue, here is the response I received today from the CNBC. Their email changed from the CCBC which is probably what caused the delay in my case:


    Good afternoon,

     

    Thank you for your correspondence and for providing these documents.

     

    I am sorry that your defence was not processed when we received it. I cannot see from the notes on your case why this was not done so I have raised a complaint as you requested to look into this. The reference is xxxxxxxxxx. Someone will now look into this and respond to you shortly.

    I have also set aside the judgment as you submitted a defence before it was entered. I have sent copies of the orders from District Judge xxxxxxxx to you by post today that ordered this. The claimant has been sent a copy of your defence and should now respond to us to tell us if they want to proceed with the claim. You’ll be notified when we receive their response.

    I hope this is of assistance. If you need more information please contact us.

    I have received a response from DCP legal solictiors that the intend to proceed. From the templates defence post I see this point 7:

    7: Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire and the usual intimidating template letter saying they 'intend to proceed'. Nothing of interest there. Just file it.  YOU MAY HAVE TO WAIT TWO MONTHS OR SO FOR THE NEXT STEP TO HAPPEN

    I note that the DQ should be emailed to: DQ.CNBC@justice.gov.uk in the defence template post. But I think that email is inaccurate as it seems it changed in January 2024 and should be CCBCAQ@Justice.gov.uk?

    No. That's the old email.  It changed 6 weeks ago and our advice is correct.

    Good afternoon, I have not yet received the DQ from CNBC, how long should I wait before chasing? The judgement has been set aside, but the claimant wishes to proceed and has provided their own DQ filled in anticipation. Thank you
