My house is not register in land registry

don’t know from which part to start but this Company supposed to not exist !! Braking so many rules of SRA Code for solicitors !! 

I bought a house using this company in 2021 as I was first time buyer , today is 2024 and they failed on register my property in land registry , they had time in LG until June 2023 as there was so many complications, they was keep telling me that they can’t do anything until the owner who sold me the house will need to comeback to his solicitors and sign ✍️ the right documents !! Excuse me!? Where they have been in this whole process !? I pay for them service and for registering my property ! They never clearly respond to my question ! They blame other solicitors and the seller and now they want me to pay for them service to sort it out all that !! I have reported them
To the legal ombudsman and waiting for them help , my property is still unregistered and if property is unregistered is a bigger chance of fraud or repossession or many different aspects. 
I got very confused since all this process as they make me to believe is not them fault ! And from beginning I really do believe them , but when came to the time when the seller has sent me message of telling that is not his fault and he done everything what he been ask , and when I forward this message to this solicitor as at this time I was still trusting them , they have transfer my case to somone new in the company who wanted charge me for no win no fee but actually it wasn’t no win no fee for sue the seller for dishonesty but on the same time they was stating me that is really hard to prove that somone was dishonest… really confusing everything and they didn’t tell me on the respond of my complaint to this firm that I have all the right to use Legal ombudsman if I’m unhappy about them and in emails o have asked them so many times if is a right thing to complain to the ombudsman - but not lack of them respond to my question like so many others !!!! I hope the obudsman will help me and to my family !!! Such a bad experience and big emotional distress. 

Ps ; the land registry application has been canceled because I have signed with my husband different plan than seller , so now are difrent 2 plans which are not match

please if I need to anything else ? Is really stressful

    Can you please clarify - when you say that house is not registered in the land registry, do you mean that there is no entry for the property at all, or that the register entry  is not yet showing you as the new owner ?

    How old is the property ? 
  • When I bought the house my solicitors suppose to register in land registry and from the beginning they sent an application to the land registry in September 2021 but because the land registry chalenge application so they sent 2 queastion to be answer regarding the plan which has been atached to the property they had time until July 2023 and they haven’t responded to this 2 queastion relating my plan , after a while I have founded out that there are 2 difrent plans , seller have signed difrent plan then I’m and my husband , 

    my solicitors never clarify what those 2 queastion was only they has told me is realating to the plan ant until plan issue will be not resolved they land registry will be not sorted, now they don’t want me to help unless I will sign a contract for sue the seller with a very hunch amount of money which I’m responsible to pay and when I asked them what arguments they have they told me they can’t comment on that , they will comment I give me them thoughts once I will sign this contract . They challenge ombudsman decision and they told them to dissmiss my case but ombudsman didn’t and I will now need to provide some more evidence to the ombudsman not not sure what they will ask for yet …. 

    The property is from 1979 but is nothing about that has never been register it was is just now this problem with plans , and until will be not sorted no one can register my property and I can’t sell or remortgage with better deal because I’m not official register owner 

    I don’t know who that fault could be that is 2 difrent plans

    I’m leaving at this property but I’m not official owner so I can’t sell , remortgage, etc … I don’t have any right , I can’t even put a fence as there is a problem
    with my land with the acces way …. On my plan is my land and with a share access , but not with the full share acces … 

    with the seller plan is my land but he can use the whole driveway

    Before going to the ombudsman, did you follow the solicitor's internal complaints process (yes or no?). If not the ombudsman is likely to refer you back to the solicitors.

    What documents do your solicitors want the seller to sign?

    What Plan did you sign? What Plan did the seller sign?

    You will need to be clearer with what the issue is if you want help.

    It sounds like this was a first registration and/or a transfer of part and that the issue is with the paperwork provided by the seller on completion?  It sounds like your solicitors have been trying to get this resolved with the seller's solicitor but this has been unsuccessful, hence them suggesting taking legal action against them to force them to sort it. Unfortunately it does cost money to sue people if they don't keep up their side of a contract.

    A question I suppose would be whether your solicitors should have noticed the issue sooner- either before or after completion or whether this was always only going to be picked up on registration - hard to guess without knowing what the issue is. 
  • when you say that house is not registered in the land registry, do you mean that there is no entry for the property at all,  yes or no? , I’m really sorry not sure if understanding your question… there it is a entry to the property I live  at this property for almost 3 years but I’m not register owner there is no my and my husband name register in land register , as my solicitors fail on registering me and my husband… 

    so officially I’m not an official owner in the property but I paying mortgage 💸 for this house 

    or that the register entry  is not yet showing you as the new owner ? yes or no? Yes is not showing as I’m the owner of the property.

There was plan attached to the Land registry form which me and my husband signed and was witnessing properly so my solicitors after 2 years later when sale hapend and he got his money wanted him to sign does plan what I signed in 2021…. But he refuse and because plan issue as there are 2 difrent one land registry cancelled application ..

    We signed the plans with a slightly difrent terms of accesway to the plot next to it , only giving a single use with 70% of driveway 

    his is 100% of driveway which mean a whole driveway 

    but on both plans I’m the owner of the driveway not him.

    This was first registration done by my solicitors in 2021 , but in February 2023   Land registry ask my solicitor to respond for 2 queaston realating the plan but my solicitor wasn’t able to answer to them queastion so land registry cancelled them application and when I say to them that they will need to sorted this issue they promise they will do but after more than half year they didn’t do anything about it , and now they want me to sign a contract and pay so much money for sue the seller because they say was dishonest but when I’m asked them : 



    2. Can you please describe the objections your firm has against Mr.F and why you think he is dishonest as G D has told me ?  I am not sure what Mr D has told you and I cant comment upon that. Once you have provided me with the signed form I will give you my thoughts on the matter. please note as a general point that it is very difficult to prove someone has been actively dishonest.

    It sounds likely that title to your property is registered at the Land Registry, but not yet in your name?

    The fact that a plan had to be signed suggests you were buying part of a larger property.  Is that right?  Were you buying a newly built house from a developer.

    It is not clear entirely, but it sounds likely that the Land Registry cancelled the application because a corrected plan, signed by the seller, was not sent to them.  The reason for this is not clear from your posts, but it sounds from your first post that the seller is not cooperating.
    And my husband and I ended up with no Land registry , and we have  no any rights even to sell a property .. I reported to the ombudsman after 8 weeks I complain to my solicitors who ignore my complain 
    Some points above in bold.  Generally in trying to resolve these matters it is better to avoid throwing around allegations of dishonesty.  Suing someone for dishonesty (as your first post mentions) is highly dangerous.
