It's on the 11th November. I plan on submitting mine early next week. I never received any communication from the court with a deadline date.Gr1pr said:You should be writing and submitting your own witness statement bundle, especially because you have now received theirs. The newbies sticky thread that you read has this stage in a section
When is the witness statement due by. ? Your court order from your local civil court tells you this , its the same deadline as the claimant ECP and QDR had
When is the hearing date. ?
Thanks,
Maria0 -
You did, that court order will have a paragraph about it, stating that it should be no later than 2 weeks before, so its definitely due, possibly on Monday , especially because you have received theirs, meaning that they read the court order and acted on it regarding the deadline1

Ahh I see, I am currently working on it today and will have it ready by Monday, however I feel like I've already lost after reviewing their defence 😢Gr1pr said:You did, that court order will have a paragraph about it, stating that it should be no later than 2 weeks before, so its definitely due, possibly on Monday , especially because you have received theirs, meaning that they read the court order and acted on it regarding the deadline0 -
They haven't issued a defence.
They've supplied their usual template witness statement. This is the same as every case.
Is it even signed by the parking firm employee?
Are the signage photos dated (relevantly)?
Is the landowner authority in date? Is it signed by the actual landowner?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They have provided a copy of the Standards of Service Agreement between. I don't think it is signed by the landowner.Coupon-mad said:They haven't issued a defence.

Your court order should state something like
"each party must send to the court and each other, such documents as they wish to rely on, at least 14 days before the hearing date"?

Is there a template to use for the Witness Statement? I'm struggling to find a template on the forum. Apologies0
-
No, no templates, each case is different, so templates don't help, just recent cases that have excellent witness statements, some of which have just concluded or been discontinued0
