I suggest you start a new thread of your own where you will receive bespoke advice.  Give us a few more details about the issue, especially date of issue of claim form and when (if you did) file an AOS.  Also all the advice you might need is in the NEWBIE sticky.

When you start your own thread and give the detail that @Le_Kirk suggested, then you will get more help.

    Until then... good luck.
  • Thank you KeithP - sorry didn’t realise, explains a lot.  I’m new to this and in bit of panic so grateful for any guidance

Go to the top of the forum,  look at the red box on the right,  it says Create new

So Create a new thread of your very own

Add a suitable title,  with initials of the claimant parking company,  then DCB Legal court claim,  example below

    ECP DCB Legal court claim

Then add some details,  issue date,  AOS date plus a redacted picture of the POC on the bottom left of the form,  after hiding the VTPRM details first

    Hello again, Team Justice 🫡

It's been some time. The last time I updated this thread was back in March. I followed all the 12 steps and absolutely nothing happened until now (a whole 9 months later!!).

I've now received a letter from the court to say my case has been allocated to the Small Claims Track for a hearing. It says the date & time will be communicated to me at a later date, but that I must submit all documents I wish to rely on to the court & other party by early January. In the meantime, it encourages us to attempt to settle (but I have not been offered a mediations service).

Separately, DCB Legal have emailed me and offered to reduce the "fine" to £60 in order to settle.

I'll start working on my Witness Statement shortly, but my questions right now are:

    1. I think the requirement for a mediation phone call was introduced after I'd submitted my own DQ. Am I not entitled to one, in this case? Should I argue for one?

    2. Should I respond to DCB's email at all, even just to say that I refuse to make any payment and I'll see them in court? (Or is there any merit to responding with an alternative offer? I assume not as that might give the impression of accepting liability, but I'd be interested to hear opinions)

    3. Should I submit my costs of losing a day's work to attend this hearing at this stage, even without having a hearing date and without having submitted a counter claim in my DQ?

    4. How do I know if my Witness Statement should be catered for the IPC or BPA?

Thanks so much to you all for your time and attention!

    1) no, just follow the process,  complying with your court order

    2) you could respond with a drop hands offer,  £0 , both sides walk away bearing their own costs

    3) yes, include it within your Witness Statement plus Exhibits bundle,  as an Exhibit

    4) check their membership on the BPA AOS members list and the IPC AOS members list,  plus the NTK PCN letter would tell you,   C P Plus are part of Group Nexus and always been BPA AOS members

If they offered £60 , they are close to discontinuing,  so this thread will also be linked in the discontinued cases thread by Umkomaas that you were linked to earlier , eventually

Please change the thread title to something like

C P Plus DCB Legal court claim
