I wouldn't massively overthink this. As long as you work through all the required court stages, DCB Legal will discontinue. It could happen at the receipt of your Defence, or the completion of your Directions Questionnaire, your Witness Statement, or at the time they need to pay their court fees. But, as sure as night follows day .......  Look below and see how the scam operates ....

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

@Umkomaas thank you for this. I've just been scrolling through the many discontinuations and that's massively encouraging. These vultures need to be put in their place. I want to extend a massive "thank you" to you, Coupon-mad, and the many others that commit their time to helping regular people to fight back!

@Coupon-mad brilliant, thank you  below are my first 3 paragraphs from the Template (I made some edits to the first paragraph, removing "It is denied that any conduct by the driver was in breach of any term" and adding that the POC is BS). Please let me know what you think:

    1.  The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  Further, it is denied that this Claimant (understood to have a bare licence as agents) has standing to sue or form contracts in their own name. Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear due to contradictory information presented in the boilerplate text in the Particulars of Claim ('the POC') and prior email correspondence with the claimant’s legal representation (DCB Legal Ltd).

The facts known to the Defendant:

    2. The facts in this defence come from the Defendant's own knowledge and honest belief.  Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper.

    3. The claim is based on an infraction that allegedly occurred in 2022. Due to the amount of time passed before the Defendant became aware of the claim, the Defendant is unable to recall the driver of the vehicle, nor the alleged breach of terms. The Defendant has made multiple attempts to contact the Claimant ahead of the filing of this claim and was met with intimidation tactics and ignorance. The Defendant was forced to obtain copies of the original PCNs through a Subject Access Request submitted to GroupNexus. Email correspondence between the Defendant and DCB Legal will evidence that DCB Legal states that their client (the Claimant) “does not comply with the Protection of Freedoms Act 2012”, directly contradicting the Particulars of Claim.

That'll do. Very good.  They'll discontinue at WS stage this Summer anyway.

You will be using our detailed Template Defence - see the top of the forum - which leaves you ONE paragraph to add. This month I've even started giving people a generic script for that paragraph too! Leaving people literally ONE DATE to change, and your name & claim details added at the top.

Signature and date at the end. Job done.

It is twenty times easier than any appeals system. Done by email. No risk. No cost.

No hearing because DCB Legal discontinue.

No solicitor needed at all. Dead easy!
