G24 parking charge for overstaying AND hire car company admin charge

    G24 have had a copy of the car hire agreement (I believe - it was in the email I had from the car hire company that first told me about the parking fine. This is what I mean though when I say I don't know 100% what correspondence has been had with G24 - they've had nothing from me directly, until the letter I got today.)

    Why do that? As I read it, pay or not you still have the Hirer's admin fee to pay as well as the amount you think you should pay for a charge/notice that you haven't even seen yet.

    I understand what you said earlier about the current stress and demands on your time, but do you really want to open your wallet and let a scam operator dip in to your hard earned ?

    Perhaps email G24 to say they have already had it and where is your Notice in order to appeal ? Keep kicking back if you can. Don't forget that even if they try court that is miles and miles down the road and you might be in a far stronger position to fight

    @Trainerman You're 100% right, I don't want to because they're scum. But to be honest my parent is ill at the moment and I don't think I have the time and energy to dig in to how to deal with it.

    But it has only been raised here today and none of us have had a chance to help you yet.  Like many here, I was out tonight.  We fit these replies around our real life stuff. This is the sort of gentle chat to carry on over the weekend.  Nothing urgent and it's not a fine. No-one pays G24.

    I said you are playing with fire if you do nothing purely because the lease firm might pay it if they get another letter.  That's all!  I didn't mean you were in trouble.  It's only a private PCN invoice.

    My reply wasn't meant to cause you to think you need to pay it. Far from it! I replied under your post where you said you were going to sit and wait, despite knowing that G24 were saying they wanted one more bit of paper to transfer liability.

    This is easy to sort.  Get the lease firm to send them the hire agreement again.

    I totally appreciate that. Sorry if it came across as a "no one wants to help me immediately this evening so I'm throwing in the towel", that wasn't what I meant. It's more that I've got so crappy things going on atm, and seeing this new letter tonight was a lot - it just made me think "sod it" and pay it and get it out the way so I can focus on more important things. (Putting on the pressure is obviously exactly what they want!)

    I appreciate both yours and @Trainerman's comments since. I'll take a breath and not pay them.

    This is easy to sort.  Get the lease firm to send them the hire agreement again.
    I think I'd rather send it myself to them as I don't want to keep involving the car hire firm in case they get frustrated and decide to pay it? But I'll phone the car hire firm tomorrow and speak to them directly and find out for definite if they sent the car hire agreement. They've been helpful previously.

    If they didn't send the car hire agreement, I'll do it, as well as mention as @Trainerman suggested that I haven't had a Notice to Hirer yet.

    You can't send it yourself.  The transfer of liability can only come from the hire firm.

    There is an alternative: you could just say the Hire firm has passed you a copy of the NTK and has transferred liability as far as you know, and you wish to appeal as DRIVER.

    If you do that, it hooks it completely in your direction.  Then - after your appeal is inevitably rejected - you can ignore them.

  • Ok. I'll get in touch with the car hire firm again to check they sent the car hire agreement.

    I have had a look again at the PoFA this morning with a clearer head. The car hire firm told them on March 4th that I was the keeper/hirer. Presuming the car hire firm sent them all the documents they needed to, am I right that G24 has until 26th March to send me a NTH?

    (2)The conditions are that—

    (a)the creditor has within the relevant period given the hirer a notice in accordance with sub-paragraph (5) (a “notice to hirer”), together with a copy of the documents mentioned in paragraph 13(2) and the notice to keeper;

    (b)a period of 21 days beginning with the day on which the notice to hirer was given has elapsed; and

    (c) ...

    (3) In sub-paragraph (2)(a) “the relevant period” is the period of 21 days beginning with the day after that on which the documents required by paragraph 13(2) are given to the creditor.

    If that's the case I'll ignore the second letter and wait them out.

    While they do have to get the NtH to you by day 21, G24 will pay no regard to the intricacies of the PoFA requirements (very few PPCs do).  In law, failure to comply with the requirements means they cannot hold the hirer liable for the charge, but it will need a Judge to tell them that. They won't accept that from anyone else. Nature of the beast.

    No doubt you'll get a NtH by whenever, so deal with that as and when. G24 rarely, if ever, try court claims. If they do, the forum will help you sort that out - but that's months away, so one step at a time, no panic, we're always here to advise and guide you. You won't be paying any private parking charge!
