    Just to remind us all, there's a hearing on Monday and it is to hear the OP's application that some untrained rookie at the CNBC told them they HAD to put in, having misled the OP that the defence had been struck out.

    It hadn't.

    What a mess.  Luckily they got help with fees so this application cost nothing except wasted time.

  • Guys thank you honestly appreciate it! Okay so witness statement sorry if I’m asking a silly question but reminder I’m new to all of this 

    the witness statement I’ll email to Edmonton county court today and should this witness statement only explain why I’ll be coming to court Monday? Or should it also include the parts about the PCNS and me being a tenant etc

    Anything you email to the court, such as your WS must also be copied to the claimant or their solicitor, if they're using one. A single email addressed to both recipients and CC's to yourself is sufficient.

    I'd include both - but not using a template.  But do use the full statement of truth.

    And DCB Legal are NOT the claimant.

    Send it TODAY.

    Be concise and concentrate first on the reason for the application.  Attach the email/letter from the CNBC that told you your defence had been struck out.

    I think the Judge will quickly realise you were misled by the CNBC and will them use the time to ask you about your defence.

    I don't think(?) you've shown us the POC so we can't tell you whether to exhibit Chan.  I would attach that transcript if the POC don't state the breach.

  • 1.     I am xxx of xxx and I am the defendant against whom this claim is made. The facts below are true to the best of my belief and my account has been prepared based upon my own knowledge.

    2.     In my statement I shall refer to exhibits within the evidence supplied with this statement, referring to page and reference numbers where appropriate. My defence is repeated and I will say as follows:

    Preliminary matter: The claim should be struck out

    3.     The Defendant draws to the attention of the court that I was informed by CNBC that my claim had been struck out. I was informed of this when I called on 5th December after logging into to MCOL and seeing information regarding a general sanction. I proceeded to call CNBC who informed me the DQ had been sent to my previous address of: xxxxxxxx


    They questioned the address on my claim to which I informed them was my current address.

    1. I made them aware that I hadn’t lived at xxxxxx since July 2022 and informed them I had received the claim at my current address of xxxxx copy attached below. The representative at CNBC then followed up with the email attached below advising me my claim had been struck out. And to fill out an N244 application and to resend my DQ.

    1. I intend to completely defend this claim. The PCNS were issued even though I was a resident of this building. The car park also being gated with fob only access. Only accessible to residents. I have attached a copy of my defence for reference.
