    If the hearing tomorrow is in person and it's snowing nearby, set off very early.  Don't let anything stop you (or is he attending without you?).

    Please let us know what happens at this hearing, and in the end re the appeal over the ludicrous 19 x £160 that lady Recorder granted, too.

    The Recorder last time may have been part time and just not grasping the scam, and perhaps not getting that a resident has rights that in most cases trump some scam clamper with cable-tied cardboard signs:

  • I lost again. 
    Because I could only obtain a copy of the tenancy agreement and it wasn’t signed. Judge awarded £100 per PCN + 3% total £785 instead of £1900

    Seems very unfair. How on earth could you have had an old signed version of a tenancy agreement?

    District Judge this time?

    Good luck with the appeal re the other one where a clueless Recorder granted 19 x £60 extra, for no justification.

    Your landlord and the letting agents will have it.  You could ask for it under a SAR. They have to release it.

    Omg really? So they can’t refuse? Because we didn’t part on the greatest of terms tbh

    UPDATE 

    - Claim one: part discontinued (2 PCNs) then Judge Cohen struck the claim out for poorly pleaded particulars

    - Claim two: DCB Legal discontinued

    - Claim three is for £3947.84 and is for 19 pcns 

    - Claim four also multiple PCNs

    - more claims coming as there are more LBCs


    Does anybody have any pointers for valid points I can bring up about this sign at my hearing on Wednesday? This is the only sign included in DCB legal witness statement

    tenancy agreement I had to request from estate agent they didn’t have our old one and I didn’t have the old one either as I left 2 and a half years ago  so they printed off our old tenancy agreement but without signatures  

    OUTCOME OF CLAIM THREE:

    I lost £3990.20 judge granted claimant 

    The judge's words were "you’ve been given incorrect information. You have no right just because you’re a tenant" But advised me to contact my landlord which is impossible I moved out two years ago

    Perhaps the suggestion from the judge was that you could recover this money from the landlord, if they gave you a contract with parking rights that did not actually exist.

    This is a worrying result for anyone on ASTs. An invitation for PPCs to abuse tenants on ASTs knowing that the landlord most likely won't give a flying something-or-another about it. If the tenancy agreement included the right to use the parking area without extra charge (I can't remember what it said - I'm sure it's somewhere in this thread) this result would imply that the signs are stronger than the AST contract?
    Yeah I still have it. Judge didn’t ask to see any of my exhibits although she had them upfront. I brought extra copies. I stated my contract doesn’t say I need to display a permit. It says that I can use any bay permitted.

    I told her I have a key fob for entrance into the car park.

    I told her that I have had another claim for the same building struck out.

    She didn’t care. She granted them interest of 4% and 160£ per PCN 19 in total 


    I’m devastated because I can’t pay it. And now my credits going to be ruined.
