DCB Legal Court Date March Resident

There are these two images also0

So you are telling us that DCB Legal have NOT included the contract (sign) attached to the detailed POC? So they ARE in breach of the clear terms of the Judge's Order.
And there are images of only 4 windscreen PCNs not 5 as they listed?
If so, email the local court and tell them that the Claimants are in breach of the Order dated xx/xx/2024 because they did not attach a copy of the contractual sign. There are no copies of the Claimant's sign (the alleged contract with the driver) only a Nuffield Health sign referring to a 'fine' but no images of any sign with t&cs and no obligations or agreement to pay parking charges to the C.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Before I email I just want to double check if it says 5 PCNS do they all need to be different dates? Because there are duplicates of the same image in with the documents they’ve sent but they are the same date and time0
-
And no double and triple checked I’ve uploaded everything they’ve sent here minus the images of my car with NO PCN on the windshield. There’s around 12 of those images but nothing on my windscreen and no pictures of any signs other than the ones I’ve uploaded here0

Also do I cc in dcb legal to the email I’m going to send the court to point this out or not0

Not only have the eejits at DCB Legal failed to provide the evidence as ordered by District Judge Cohen, they have also not shown the contract that gives them authority. Just saying that the contract was mutually extended when it is dated 2015 is insufficient.
Failing to itemise their "contractual costs" and failing to show what that sum is in the signage or on the PCNs is another unreasonable action.
Stating that the interest charged is 8% above the Bank of England base rate is also wrong. Interesting is calculates at a simple flat rate of 8%, is discretionary. Also, claiming £195.92 in interest, even on the outrageous £350 "contractual costs" plus the £500 PCNs is wayyyyyyy OTT. At the flat rate of 8%, for just one year would only amount to £68.
I would advise that you address all these breaches of the order and the abuse of process directly to District Judge Cohen at the court. He is as sharp as a nail and will not be fooled by the intellectually malnourished, failed legals at DCB Legal.
Before you send anything, please show us what you intend to put in your email/letter.2 -
To Judge Cohen
I hope this email finds you well.
I have received an amended POC from DCB Legal and have noticed that they are in breach of the requests you outlined for claim xxxxxxx
I have highlighted what I believe these breaches to be below
- DCB Legal have not included the contract attached to the POC. There are no copies of the Claimant's sign (the alleged contract with the driver) only a Nuffield Health sign referring to a 'fine' but no images of any sign with t&cs and no obligations or agreement to pay parking charges to the claimant.
- They claimed that there were 5 windscreen PCNS but have only included images of 4 dates - 03.08.2020, 06.07.2020,05.08.2020, 21/08/2021
- They have said the contract was “mutually extended” when it is dated 2015.
Is there anything to recommend adding
do I cc in DCB legal ?0 -
You don't write to a Judge by name (and please don't use ChatGPT). None of this awful AI speak: "I hope this email finds you well." Why does anyone use that awful app?
ONLY raise ONE point.
The one that breaches the Order.
Nothing else.
Simply email the Court. Not DCB Legal.
Say you wish to alert the Judge to the fact that you have received wholly inadequate new POC.
Quote the 'for the avoidance of doubt' point 2 in the Order that I screenshotted.
Then say that no copy of any contractual sign was attached with the new POC. This breaches point 2 of the unless order. There are no copies of the Claimant's sign (the alleged contract with the driver) only a Nuffield Health sign referring to a 'fine' but no images of any parking t&cs sign with obligations or words that may have created a contractual agreement to pay parking charges to the claimant.
.. and end by saying you respectfully await confirmation that the Claim is struck out due to the Claimant's failure to comply with Judge Cohen's 'unless' order.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Johnersh might well be able to put this better than me, as I always just 'wing it' and he's a solicitor!
Also I suspect he'll say you MUST copy in DCB Legal...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
