Lease car untaxed

I took out a private lease on a car on March 2023. As with all lease deals the finance firm remains the owner of the vehicle and it is therefore their responsibility to tax the car.
I have just found out that they have failed to do this and this means I have been driving a car that is also uninsured.
Will this be grounds for me to cancel the lease agreement?

    What does your contract say about responsibility for taxing?

    It's the registered keeper that is obliged to tax the car not the owner... the DVLA have no idea who the owner of cars are as there is no central database of vehicle ownership. 

    For most leases the financer remains the registered keeper and so it includes the road tax but not in all cases plus some people mix up PCH with PCP etc and don't really know what they've got. 

    The car is only uninsured if you haven't bought car insurance, car insurance doesn't require the vehicle to be taxed for it to be valid. 

    You need to read your paperwork

    It's difficult to believe the car has gone for almost a year without the DVLA pursuing the RK.
  • My contract states that the cost of the car tax makes up part of the monthly payments. It is clearly listed as all inclusive of delivery, warranty breakdown cover and road tax.

    Registered Keeper, not owner, there is no registered owner. So who was the registered keeper changed to? Would be understandable that they cannot tax it if someone else has claimed responsibility for the vehicle. Have you actually checked it wasn't taxed as just because they didnt doesn't mean whoever claimed responsibility for it didnt?

    Yeah, thats urban myth... show me one policy book that states the car must be taxed? Over two decades in insurance over 12 different underwriters and never once even checked if a car had tax let alone considered declining a claim based on the outcome.

    I think the point being made is that there is no such term - it's just Owner

    If you are the registered keeper then its your duty to pay the road tax... there is no registered owners, the DVLA has no idea who owns any car in the land other than its own hence why it has to be the RK that they chase.

    Sounds like maybe you were the author of your own misfortune if you have transferred the RK to yourself?

    So, if that's the case, you are the RK and it is your responsibility to tax the car. So you have no complaint.

    But usually the lease company are the RK.

    It's not with some lease cars.  The least company pay the tax as part of the deal, if they don't, it's really their issue to sort.
