If you do not sign a phone contract

I am waiting to hear from a leading phone company, as I have asked for an itemised bill, and they said they would send me an  email in 5-7 working days.

Last October, I had gone to their shop to ask when my contract was ending, and with no discussion, I was to be a customer, however, there was no signed contract, just the salesman typing into his tablet, which he swiftly put in a drawer away from the desk we had just shared. He acted shifty, walking backwards..

I was nudged, manipulated, into a what feels like an indefinite pricey arrangement that they can organise when they want, but that makes no sense, from a consumer rights pov, except maybe to them.

Earlier this week I just wanted out. So I asked to leave, And they offered me a new deal, but the email they gave me to register in the relevant dept did not work.

Any thoughts will be appreciated. Thanks.

  • You had a contract prior to entering the shop.

What was this contract for a phone and airtime package or SIM only?

How have you been paying for this contract and for how long?

Have you asked them how much it will cost you to leave?

Main thought is that the story is really hard to follow or to know what the problem is.

There is no legal requirement for contracts to be signed, they require (outside of Scotland) an offer, acceptance and consideration (aka payment). Evidence payment is being made generally is accepted evidence that clearly the paying party agreed to the contract.

You signed up to a contract in October so have made at least 3 payments... what's the sudden problem now?
  • Thanks. Yes. I had a signed contract.

Thanks but I am not sure quite what SIM-only means, but I'll go with I bought my phone in one shop and got broadband in the shop under question here.

I first joined the company in 2021 paid by direct debit.

I did ask two days ago, just wanted to cut my losses, and they put me through to a sales dept, but I needed to register with an email they gave me that did not work, Which brings me here.

You agreed to a contract with a minimum duration, signing or not is irrelevant, it will be very expensive to exit the contract early.

Still not easy to follow , is your broadband a ‘landline’ broadband package or mobile  ‘data’ , what is it you want to exit from , the phone or broadband or both ?
  • This is very unclear.

What has broadband got to do with your mobile phone?

Do you have a phone contract and a broadband contract?
