UKPC Crawley Leisure Park - Left site - Too late to appeal
Comments
-
It seems like there is no email to send it to. The only option is to send the letter by post. It doesn't let me do it online as it says that it is sent to the debt offices. Any help with that?0

They don't want to make it easy hence posting it and of course they can say it was late or delayed, you are dealing with chancers not John Lewis. All immaterial anyway the time for appealing has past, you are now in ignore mode when the silly debt collectors letters start dropping on the door mat, then they will file the court claim. It's then the real fun starts against these greedy idiots.1

One email that still works AFAIK, is
appealmoreinfo@ukparkingcontrol.com
Remove this as it's not true:As specified in:
Schedule four; Protection of Freedoms Act 2012: paragraph 8; sub-paragraph 7:
'When the notice is given it must be accompanied by any evidence prescribed under paragraph 10'Nothing was ever prescribed under para10.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Please support this.
So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted rate/full rate pcns/court claim letters were sent though they offer no evidence to prove this.
Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.

Petition signed! Thank you!
The keeper received the LoC. As per the newbies thread, here is my draft to send to their info@dcblegal.co.uk email correct? I've mixed the two templates accordingly. Let me know if I should not do that.Dear Sirs,
Your Ref. ############
Proposed Legal Proceedings
Claimant: Uk Parking Control Limited
I refer to your letter of claim.
I am the registered keeper but I wasn't driving the car. The Notice to Keeper was not PoFA 2012 compliant. UK Parking Control Limited (UKPC) must cancel and erase my data as I am not liable party and I decline their request to name the driver.
If you persist in processing my data and in the event of filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500. This will be claimed as damages for distress arising as a result of clear breaches of the DPA 2018 and/or the Protection From Harassment Act 1997.
I will rely upon the case of Simon Clay v Civil Enforcement Ltd and similar cases that have succeeded. Cancel the PCN.
The alleged debt is disputed and any court proceedings will be vigorously defended.
I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').
I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".
Don't send me your usual blather about that.
I have two questions, and under the PAP I am entitled to specific answers:
1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?
2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?
Yours faithfully,
KEEPER NAME
Here is the LoC. Thank you lovely people!

Remove the first half rant, as that is a POFA compliant NTK on page one.Instead change the bottom bit to 'I have three questions' then in 3 ask for their client's evidence that the driver 'left the site'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Imo, leaving site is an unfair term in a consumer contract.
Unfair contract terms guidance: CMA37 (publishing.service.gov.uk)
You never know how far you can go until you go too far.1 -
Put a complaint in about that letter, the footer clearly states "Cant pay We'll take it away" they can not do this, and have no powers to do so

Here is the response the keeper got.
They're twisting it to say "you ask for evidence YOU left the site." But I asked for evidence that the "DRIVER left the site". Should i reply with that? I should also say that simply stating being observed leaving the site is not evidence. I need evidence for the observation that was carried out. Want to ask them, if they were observing, then how many passengers were in the car? Did they observe them exiting the vehicle and leaving the site? If so, where is your evidence of this? Who was the driver? What did they look like? etc.
Any suggestions?

Usually muppetry by inept staff: "You have were observed leaving the site by a traffic warden"
Apart from the complete lack of proof reading can they actually have "traffic wardens"?
And how does the "traffic warden" know who "you" are?
Are you mates or something?1
