  • Who provided the CCTV footage and would their manager/operative be prepared to sign a short note confirming the provenance and source of it?

    Does it need to be signed as well? Its outside of the property, from a restaurant. They provided me as i requested them. Can you pls tell me, how it should be written?

    Yes: you need to show the source and that they voluntarily let you have a copy for limited data purposes of using it for your PCN case, with their agreement.

    Clearly that needs them to sign to say 'yes we released this to Mr xxxxxxx and it is footage from DATE.

  • If the defendant goes out of country, does he need to inform the ppc that, he won't be able to answer any court letters during that period? Or any court letters arrive during the period when the defendant is out country & isn't aware of it? What is the legal proceedings in that scenario?

    A day trip to France should be ok.
    If you are going to be 'out of the country' for six years, that's ok too.

    Anything else and you'd be wise to inform the other parties of your whereabouts.

    You simply can't do that.

    YOU MUST be contactable and able to respond to court letters. Someone at home must open your post daily.  This is unsafe.

    And it would be daft to tip off the PPC "oh, I'm away & won't see any post" because they'll send something in that time, deliberately and also they'll pounce and tell the court if they know you will have missed a deadline.

    You risk your defence being struck out. You can't go into radio silence. Someone needs to be opening your post, taking photos of all court-related docs and emailing them to you to respond to.

  • Thank you so much for the valuable information. I was thinking of offering the ppc 50% of pcn charge, as i'll be out of UK for few months. As i won't be able to answer the court letters, if issued, i thought of informing them ahead, so that, they can accept this offer. As they rejected my evidence of cctv footage, now either i have to appeal to POPLA or ignore all the letters except court letters. As i have doubts over POPLA judgement, i'm in dilemma, should i go for court judgements or pay the amounts. Can you pls give me the idea, how long it takes to get POPLA decision and after that, how long it takes for the 1st court letters arrive? My last date of appeal is, 8th February.

    DO NOT offer them 50%.  If that was an option the NEWBIES thread would say so.  Why are you wanting to pay the scam?

    If you are only at pre-POPLA stage you aren't anywhere near court stage.

    Appeal to POPLA as late as possible. Your last day to use a POPLA Code is DAY 33 (not 28 days as they tell you!).  Include a link to your CCTV evidence and proof if its source, as part of your POPLA appeal.  Use the other points in post 3 of the NEWBIES thread.

    Show us your draft this weekend, or next week.

    That whole process will take you through to about April.  And you may well win.

    If not, then the daft £170 debt demands will take up late Spring and Summer.

    Court is not quick.  But surely someone can open your post for you for the time you are away, to be sure you have only missed silly debt demands?

    IF YOU TELL A LITIGIOUS PARKING FIRM THAT YOU ARE GOING TO BE AWAY, THEY WILL CUT OUT THE DEBT DEMANDS AND RUSH TO FILE A CLAIM THEN.

    So do not tell them! 

    But some never sue...

    PPC: Civil Enforcement

    PCN issue date: 04.01.24
    Appeal Rejection letter: 12.01.24
    From the rejection date, its 28 days, so it should be 09.02.24.

    I'll be away in april, so hopefully it shouldn't be problem to get through the proceedings.

    I'll do the draft by today & will try to send it asap.
