private parking fine

Now i'm going to share my 2nd parking ticket.

Around my house, i park in the common parking, no restriction. There is a private parking land, at the end of the road and people enter the parking area to maneuvering their cars as the road is narrow and only one car can only pass by. I also do it all the time, enter there for maneuvering my car and park in my place.

In the morning 10.05, i entered into private parking for maneuvering my car and came out instantly, then park in my designated park.  Around 10.30, garbage truck came and asked to me move backward so that they move forward.  As the road was narrow and only one car can pass, i had to go backward into that parking area. I had to wait there around 5-10 mins, then after the garbage truck left, i came out. After 10 days, i got letter that, i entered their parking at 10.05 and exited at 10.40. Although i entered & exited 10.05 first, then entered again 10.30, they skipped that video. After i write to them, they didn't say about video, but said, it doesn't proof that, your car exempted from parking in that premises.

The car park is for commercial shops. The sign says, " The parking is for permit holders only. Visitors must obtain a parking permit by registering in the touch screens inside the premises and enter their full correct vehicle registration". General parking is not permitted. Breaching any of these terms, you'll be liable to a parking charge of up to 100£ & it applied at all times.

But i didn't see any sign of touch screens in the premises & it was holiday time. So parking was empty and no car came in that time.

Now my question, Should i appeal to POPLA in this regard or pay 60£ in 14 days. As i didn't read the parking signs before, i didn't know these rules. Can i raise the issue that, there was no sign of touch screens visible, which is true.

    Well it's a double dip, and they've missed the orphan images in the middle.

    Email the parking firm's DPO and demand they supply the missing CCTV or ANPR 'orphan images' of the car moving out then back in.  Tell them approx times to look for and say you will report them to the Information Commissioner if they refuse.

    POPLA can wait a month.

    Do you know who owns the car park/ parking area that they think you stayed in?

    The problem is, i wasn't member of this forum before writing to them. I was very naive to think that, they can't make mistakes as they track the car with camera and camera can't do mistakes. Now i learned that, this PPC are out of regulations, they don't care about justice & clarity and nothing but a money making machine. My first mistake was to acknowledge the situation fairly, now i know, i could have made other reasonable excuses which could be more fair to the appeal. 
    I came to know lots of rules, criteria to issue pcn esp from case study of POPLA, as well as loopholes how to get out of it. May be my mistakes will save me in future.

    I post their reply as below:

    We have no record of the above vehicle being registered to be exempt from the parking restrictions in place on the day in question. It is the responsibility of the driver to ensure they adhere to the parking terms.
    There are many clear and visible signs displayed on the site advising drivers of the regulations in force and we maintain a continuous log confirming that the signage remains in place.
    It is therefore our position that the parking charge was validly issued because of the above detailed breach of the terms and conditions set out on signs in the car park. You have now reached the end of our internal appeals procedure.

    They have no email add to contact, so there's no way to write them. They have only appeal option to reach them in their websites.  I don't have enough patience to write in paper & go to post office.

    Now what can i do in regards of the tampered image? They didn't mention about it in the rejection letter, so it seems they know about it and don't want to focus on it, rather they focus i stayed on their property more than 5 minutes whereas parking condition is" no general parking allowed" at any times.

    They also mentioned in the rejection letter that, their success rate at POPLA is almost 83% as per reports there.

    But they do have a DPO email.
    Course they do.

    I advised you to specifically email their DPO which is always on a firm's privacy page.  I was hoping to avoid pointing this out and that you'd realise what I mean by 'DPO' (Google has it as the top answer) and then confidently go find their data privacy page for yourself.

    To be fair to poster the email address is buried in the privacy statement and it tries to take you to their 'Contact us' web site.  They are required to give you a means of contacting the DPO within the statement.  (I have written many such policies and statements in another life)

  • Hello, i found one cctv footage from out of the property. It shows, i entered @9.30 and exited within 40 seconds. . Again, i entered @9.59 and exited 10.04. But in the pcn, they showed, i entered @9.15, and exited 9.49. So clearly, its the wrong timing was shown in the ANPR. Now, can you pls suggest what should be my next step? Should i go to popla with this evidence? Before getting this footage, i asked them for providing me cctv footage, but they just sent photographic evidence of 9.15, like the pcn.

    Who provided the CCTV footage and would their manager/operative be prepared to sign a short note confirming the provenance and source of it?
