    That is a high bar to cross and only winnable if the claimant has behaved unreasonably.

    Hi everyone - me again. 

    I've just received a letter for notice of allocation to the small court (Hearing). 

    Hearing is set for 4th April 2024.

    I still haven't heard back from MET regarding the operation managers email to them. 

    Furthermore, the letter states the following - 

    1) Each party must deliver to the other party and to the Court office copies of all documents on which that party intends to rely at the hearing no later than 14 days before the hearing. 

    2) The original documents must be brought to the hearing. 

    3a) send copies of any relevant contracts and agreements 

    3b) copies of any relevant correspondence between the parties; and 

    3c) copies of any other relevant documents 

    4) the judge may refuse to consider a document or take it into account if a copy of it has not been sent to the other party as required by this order. 

    5) the documents to be sent to the othrr party and the court must include the statements of all witnesses

    6) Because this order has been made without a hearing, the parties have the right to have the order set aside, varied or stayed. 



    So - what should I do now? 


    Any help would be greatly appreciated.

    Sorry - down with a terrible case of ''covid'' so my brain's all fogged up. 

    Going through the newbie threads now to draw up a witness statement. I have other relevant documents and evidence all bundled up together. 

    Am I able to submit all of this online to the court? They have included a postal address and an email as well. Hoping I can send it via email as it would be more efficient. Also, as stated above, am I correct to assume that whatever I send to the court I will need to forward to DCB Legal as well?

    Check with the court, but some have a fifty page limit for documents sent by email. If your WS plus exhibits is under that, you will probably be okay.
    You can add anything and everything you believe is relevant as an exhibit, listed in an appendix, number consecutively with your initials preceding each number, and added at the end of your WS.

    Yes, everything you send to the court must be sent to the other side as well.

    A huge thank you to coupon-mad and fruitcake for their help in the matter! 

    Met parking and DCB Legal have discontinued the claim and have sent me a Notice of discontinuance N279. 

    They have stated in their email the above form has been filed with the court, and are now closing the file accordingly. 

    Last question - Do I need to do anything further?
