Fake photos supplied with PCN

I got a PCN on the private road behind my home, 1. It says not in bay, there are NO bays at all! 2. Not a valid permit, landowner won’t supply one. 3 the photos of the area are not timestamped or dated, and are not from my area at all, I phoned a business that appears in one of the photos, it’s over 14 miles away, from my home. 4. No sign at the beginning of private road, just a sign on a storage garage. I have now received a court letter, can anyone advice please 🤞

    Tell us more about this 'court letter'.

    Do you have a County Court Claim Form?

    If so, what is the Issue Date on it?

    If you have filed an Acknowledgment of Service, upon what date did you do that?
    Your MCOL Claim History will have the definitive answer to that question.
  • Form dated 7 December, I haven’t done anything about it yet, just trying to research rules for private parking, and how best to appeal 
  • I gave all the above information to POPLA they said I didn’t give enough evidence that the photos were fake, although I told them I’d phoned a business on the photo and it was 14 miles away

    I did appeal to POPLA, they declined my appeal with that info, said I didn’t prove photos were not in my area, surely they should have been date stamped at least

    'Appealing' is no longer an option. You need to defend the claim. @KeithP will respond to you having provided him with the Date of Issue of the claim and give you pointers and key dates for your defence development.

    Have noticed particulars of claim section 3 they only mention the permit, not the designated bay’s which is stated on the PCN

    With a Claim Issue Date of 7th December, you have until Thursday 28th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 9th January 2024 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
