Hi all

Hopefully you'll be able to assist me with this!

I received a PCN for parking on 'private land' in June 2018 and ignored it.

Today I received a claim form through the post and reaching out to help. It's a bit of a concern and I have been helped on here before for a similar problem (didnt get to this stage).

The issue date is 7th December.

I have attached pics of the signs from Google Maps, and squared where my car was parked. Further down the cut through is the residents parking area. The section my car was parked at was essentially just past the entry point half on the pavement.

I don't have the original PCN/proofs (not sure i ever got sent it).

So I guess I parked past the first initial sign (front of building), but I always assumed it was the actual parking spaces and area you couldn't use as there were always cars parked where mine was.

  • Other page of the claim states I have 14 days to respond, within 14 days of the day of service. "The day of service is taken as 5 days after the issue date"

    With a Claim Issue Date of 7th December, you have until Thursday 28th December to file an Acknowledgment of Service.  Do not file an Acknowledgment of Service before 12th December, but otherwise there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 9th January 2024 to file your Defence.
    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Thank you for that. I will do the AoS tomorrow or Wednesday then. Reading through that, the AoS is done via MCOL but the defence via email instead of MCOL

    Do I need to get any proof from the collectors or past that point now?

    Wrong terminology sorry.

    Do I need to request proof (photos of my car parked there) from Spring/DCB Legal?
  • Am I ok to do the AoS today, or better to wait until tomorrow (13th)?

  • Despite the clear permit sign on the front of the building, do you think there's a good chance I can win this? The smaller font sign higher up on the sign I didn't even see in truth.
