Civil Enforcement Letter for a PCN from Subway in 2021

Hi,

I was hoping someone could help me. I have read the newbies private parking thread thread in detail but I still have questions.

I have received today a letter before action - claim for debt letter. Regarding parking at a Subway in Burton in June 2021.

I have not received a letter on this for sometime. Initially I asked them to provide me with the proof I was there for the time they state as I explained I went there, left to nip to a shop round the corner and then came back. I never received a response to my emails asking this so I assumed it was just left.

I have now received the letter below with a reply form. On the reply form it says "If you have not been able to resolve this matter by speaking to the business, you should fill in the reply form that was provided with the letter from the business and then send it back to the business"

Is the business in this instance civil enforcement? If so there is not an address for them anywhere on the letter so no way of posting the reply form there. The only business address on the letter is the one for the Subway in Burton. Do I need to send the reply form there??

I can see on the thread it advises not to use the reply forms. But there are no other means of contact? There's no mention of a solicitor. 

What do I do here? Is this likely to go to court? How do I contact them and explain I have asked for evidence and explained I was there in the time stated as I left and came back but have not had a response?

I would be grateful for any advice please.

    The first few paragraphs of the second post of the NEWBIES thread explain how to react upon receipt of a Letter of Claim.

    The 'business' mentioned is indeed Subway in Burton.
    There is no suggestion in that letter that you should send any forms to them.

    Have you spoken to the people at that Subway and asked then to cancel this as you were a valid customer?

    Thanks for your reply. I initially went on the site from the first ticket to appeal and went back and forth until nothing. I have emailed Subway today.

    It says on the other page about sending the reply form to the business.

    I did read the newbies thread about replying to the LBC. It says to go to the solicitors but there isn't one on my letter. Or to write a letter. But I wasn't sure who to write a letter to as the only address is for Subway in Burton.

    I just don't know what to do.

    You can surely work out which is more likely to achieve your objective.   ;)

    I know I cannot contact civil enforcement as they only have a phone number and my only option there is to pay. The letter implies I will be taken to court. Will this happen?

    Is all this coming from Subway pushing through to Civil Enforcement?

    I will fill out the form and write a letter to Subway and post. If this does not work, I will go in.

    You aren't filling out any forms!  Nor will you pay a penny.  Trust us.

    We know what we are doing but you need to slow down and read the resource thread at the top.  You do not have a deadline. Stop reading their rubbish.

    Did you miss the really simple step needed that I already advised?

    You've got that the wrong way round.

    Go and see the manager there first - in person.

    I did thank you. I just don't know what I need to do. That LBC said about writing a letter?
