RMA gave up - they could only supply barely legible copies of an application form. They used two firms of solicitors (but based at the same address) to try and get me to ignore this.
Moorcroft have obviously now bought the debt and to date have yet to produce a CCA, Deed of Assignement etc - this will of course prove impossible as they do not seem to exist!

My husband sent a cca request back in september last year for a DCA that was chasing an old loan with Lloyds. We had reservations about the amount being chased and so sent the request. We know the DCA bought the debt as they told us this and we were making a minimum monthly payment direct to them.

We received a reply from the DCa saying that they had forwarded the letter to their client and would be in touch.

To this date we have not heard a thing. That tells me that something underhanded has taken place, and they therefore cannot enforce it. But we have not had anything in writing to actually write the debt off. Should I send this info to a governing body, or not push the fact? Any advice appreciated.

do you think the reason why a DCA passes on a debt to another is bacause they dont have the origional cca.

I was just about to write to mine however I have received a letter from another dca saying they now have the debt.

surley if they had the cca they may as well just persue me for the debt.

Others will have the answer to this , but in my case i,m going to send the second letter , as advised earlier . And also write to trading standards if i get no responce .
  • Guys,

I would deffo do this, a friend of mine received a court summons for circa £8k from a DCA, which she knew nothing about.

She CCA'd the DCA and entered her defence stating she had requested the CCA to ensure the debt was hers. Courts gave the DCA 28 to respond if they wanted to progress the case.

DCA responded wrote back to her directly saying they didn't have it but will request from the original creditor and will send the paperwork on to her in due course.

DCA failed to respond to the courts request to respond and therefore case stayed.

It's been over 2 months since the CCA and 1 month since case stayed, since then slience from the DCA.

If she hadn't challenged the CCA then she would either be paying the DCA now or have a judgement against her.

A lot of these DCAs chase for statue barred debts, or debts that in a court of law they would lose the case for having no paperwork to enforce it.

Those of you that say you owe the debt so pay for it are correct but make sure you are actually paying the right DCA, or at least ensure they have the paperwork to make it legal.
