    Renumber it to make sense:

    3.  The vehicle ........ was in the car park as two of the occupants (children) needed to eat the food purchased and use the toilet facilities offered by the retailers at the site.  It is denied that the driver - the Defendant's wife - entered into a contract, breached any term or was made aware of any 'relevant obligation' or site boundary at this notorious location.

    4.  Further, the claim fails because it wrongly states that the Defendant is pursued "as the driver" (which cannot be simply assumed). The Defendant was not the driver and is not liable, as a matter of fact and law.  The location is not 'relevant land' and both the Notice to Keeper and the (almost 5 years later) Particulars of Claim did not attempt to suggest that 'keeper liability' applies. Thus, there can be no lawful claim against the Defendant, who is only the registered keeper.  Schedule 4 of the Protection of Freedoms Act 2012 does not apply.

    5.  Persuasive appeal authorities to support the fact that this Defendant cannot be pursued for this parking charge include:

  • I've been looking through the threads in this forum which have been very helpful. I am in the process of filing my defence for a court claim received from Met Parking at Stansted (Starbucks/Mcdonalds) dated 21st Nov 2023 and have filed an Acknowledgment of Service defending within the timescale given. 

    I parked in the car park (Starbucks side) on 18th Feb 2020 after picking my partner up from the airport. We went to get food from McDonalds and were no longer than 30-40 minutes before leaving the carpark. 
    I did not receive the first letter of claim until 3 months after the event which was a shock to receive at all considering it's an hour's free parking!
    Met Parking can't use Lockdown as an excuse because lockdown didn't start until 20 March 2020, so they had a whole month in which to send the letter of claim. We have proof of payment on a bank statement that we ate in Mcdonalds.  
    I'm stuck on how to word this part correctly in my defence to the court. I've found templates for registered keepers who weren't driving but none for drivers to adjust accordingly to fit my appeal. Could I please get some guidance on how best to write the above?

    By way of an update, I have had a confirmation of my defence through the post and yesterday I missed a call from DCB Legal. 

  • Also I haven't completed an N180 form as yet.

    Good you missed a call from somebody trying to remove money from you!  Everything in writing!  If you check back with the NEWBIE sticky and particularly the 12-steps you will learn about the DQ stage.
  • DCB legal have sent the we are proceeding with this claim email and sent their N180. I haven't emailed my N180 as yet. Should I send my N180 soon or wait for the court to request it?
