Parking court claim

Hello everyone,

Had a paking ticket a year ago. My car was parked in a business centre. Its normally allowed to be there for free at least for couple hours for visitors. The car was there for about an hour and the driver was visited some classes there. But it was out of hours and they have just give the tickets to everyone on that parking. Nobody knew it could happen and unfortunately no one helped me to solve it. Don't know how I could prove the driver was the visitor, but I have tryed to appeal and explain everything, they refused.

So I read some threads and just started to ignore everything came afterwards. Probably didn't read it properly as I received a court claim recently.

Don't know what to do now and asking for your advice. Do I have any chance to win or it is better just to pay?


Particulars of claim:

The driver of the vehicle with registration xxx

(the 'Vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract) at Moulton Park Centre, on xxxx/2022 thus incurring the parking charge (the 'PCN'). The PCN was not paid within 28 days of issue. The Claimant claims the unpaid PC from the Defendant as the driver/keeper of the Vehicle. Despite demands being made, the Defendant has failed to settle their outstanding liability. THE CLAIMANT CLAIMS

£100 for the PC, £70.00 contractual costs pursuant to the Contract and PC terms and conditions, together with statutory interest of £xx pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.04 per day.


All I did for now is I filled the acknowledge claim form.

I have also been adviced to send SAR to National Parking to find out what the information they have about me and CPR request to solicitors. Haven't done this yet becouse didn't find any information about it on the forum.

Can you advice please. Scary of the court to be honest.

    What is the Issue Date on your Claim Form?

    Upon what date did you file an Acknowledgment of Service?
    Your MCOL Claim History will have the definitive answer to that.

    With a Claim Issue Date of 17th October, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 20th November 2023 to file your Defence.

    That's three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Read the second post of the Newbies/FAQ thread for advice on how to file your defence. Follow the advice carefully and this will be thrown out at allocation stage.

    You have until 4pm, Monday 20th of November to file your defence.  Do not use the MCOL to file your defence. I repeat, read the second post of the Newbies/FAQ thread.

    Because we do NOT advise doing a SAR now.

    This is easy to defend.

    It looks from your screenshots that English perhaps isn't your first language so I wanted to say you will be fine and we are glad you found us.

    Which solicitor?

    Which parking firm Claimant?

    I am not sure now. What I didn't mention is the dancing school owner tryied to help us but the landlord refused to do anything to cancel the tickets. The school teacher also have got the ticket by the way with a court claim, and some other people as well, about ten of us. That school owner said to appeal after all, he has sent us a text what exactly we need to write there. This is a !!!!!! what I understand now and it was a big mistake that probably will ruine now any attempt to defend.

    All we had to do - let to know the reception the number plates or leave something on a dash. That what is on the sign. But nobody did.

    So I ask you again is it worth of doing something or don't waist my and your time and just pay. Especially as you have noticed that English isn't my first language and it matters.

    I also have the information that the parking rules came into force few days before the incident but can't prove and not sure if it is true. Don't know how to check. That is what the dance school teacher says which is working there for a while and also have received the ticket as I already mentioned

    Do you mean the school owner told you what to put as an appeal, several months ago?
    That's not a problem.

    An appeal a few months ago, does not affect a good defence now.

    Or do you mean that the school owner texted you this month what to put as a court defence?  Please clarify?
