    A new update on my case. I got a letter yesterday from County court where they set aside the judgement. I am not too sure what exactly should be my next step. does that mean I need to wait for the claimant to reply back to my defence or I need re file by defence or wait for hearing date.

    Exact wordings:
    It is ordered
    The judgement be set aside because defendant has filed a Response  prior to court entering judgement.
    Because this order has been made without hearing, the parties have the right to apply to have order set aside.

    Reasons
    1. The judgement was entered when the defendant had filed a response.
    2. The judgement was therefore irregular and must be set aside.

    IT IS Ordered that
    The judgement against xxx dated ... be and is hereby set aside.

    That letter,  if that is all it states, seems to put you back in the position of having filed a defence on time and CNBC  should send a copy to the PPC and/or their solicitors and you wait for them to write and say they are continuing.

    Today I got a settlement letter with Directions questionnaire 
    Section A settlement/mediation
    Section b contact details
    Section c track if I agree this is the appropriate track
    Section d hearing venue : claimants home court
    , expert evidence, witnesses
    Hearing date not available

    I believe this is the second part. And now I need to prepare witness statement

    You need to complete the DQ in line with the advice in the NEWBIE sticky and/or the 12-step process in the template defence thread.
  • Apologies, The DQ letter I receive is from Claimant not from court. It states "The court will direct both parties to file DQ in due course. In anticipation of that we are enclosing a copy". And the DQ they sent is already filled up by the claimant. So basically I need to wait for DQ send my CC- and then I fill that up and send it both CC and Claimant.
