  • From the history it looks like the email I send with defence was never received 

     attached is image with claim history, email I send and acknowledgement.

    From those email headers it looks like you sent your Defence at 4:37pm on 1st November 2023 and the CNBC sent their response one minute later acknowledging receipt of it.

    Have another look at that receipt email.
    In it you will see the line "Thank you for emailing the County Court Business Centre, please accept this as a receipt of your email".

    Clearly they did receive your Defence. You will be able to show them exactly what you sent by finding that email sent on 
    4:37pm on 1st November 2023 in your email 'sent' folder.

    Once again the CNBC can be seen to be making costly and worrying mistakes.

    You don't.  No fee. This is their error.

    You ring them up and tell them they are wrong and escalate it as a FORMAL COMPLAINT to the court service manager.

    DO NOT be told you have to fill in a N244 application.  Say no, and politely insist/instruct them to show your email proof to a Judge to set aside the Order as it is CNBC error.

    Stay on the phone.

    Takes up to 2 HOURS to be answered unless you ring at 8.30am on the dot.

  • Just an update
    I tried calling county court multiple times and they ask me to send proof of email sent on time and acknowledgement but they still invalidate my request. 
    Yesterday I forwarded my email to Local MP and requested him to intervene. Waiting for response!

  • They are saying they can't do any thing now as judgement is already entered against me. They are asking me to fill N244 with £275 fee to set it aside.

    Yes I did exactly like that. I contacted court and then they ask to email with a subject "for the attention of Manager" on the same email. I call them to check about my 1st email and they said your email was rejected and letter issued (which I just received today) and at the same time when I ask why my complaint was rejected they didn't provide a reason and instead asked me to do the same thing again. 

    I emailed again and also informed MP about it. MP also forwarded email to the court to reply why my defence was ignored at first place. 
    I will wait for next week for the court to reply me on my second email and will go through the above case you mentioned. Thanks
