CST Law - Stansted McDonald's Carpark - MET Parking Services edit: *court date*

Hi guys/girls, thought I'd start my own thread as to clog up others.

Obviously a common one at the moment.

I have an LBC (previously ignored all letters before this) with a Date of Charge going back 2 years (2021).

The only difference with my 'charge' is that the vehicle in question I do not own and have never owned. I am not TRK. I suspect it is a hire vehicle.

I've started to e-mail a response back to the solicitor, but seeing as I do not own or know of the vehicle in question, does that change things at all?

I didn't want to state about never owning the vehicle in question but then go on to be defensive about it.

Happy to paste my LBC reply here before sending if it is advised.

    So, ignore the Letter Before Claim and just await an official county court letter, if one should arrive?

    Yep and you will see several Stansted MET defences already written this Summer.  You can copy & adapt them.  You'll win in 2024.

  • Update, I have been sent the official court documents.


    The issue date is 7th December 2023. So I believe I need to wait until end of the week before submitting an AoS?

    Obviously going to use the advice on the Dropbox link from the Newbies thread.

    Is there anything other than copying similar templates I need to consider for my defence?

    Poorly worded Particulars of Claim. No mention of what the driver is accused of doing wrong and trying to charge interest starting two days before the alleged parking event.

    With a Claim Issue Date of 7th December, you have until Thursday 28th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 9th January 2024 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Is this Claim filed by CST Law?

    Thanks, I will follow; but the interest is charged in the following month. So it isn't 2 days before the alleged offence.

    The claimant is MET Parking Services Limited (London), but the address for sending documents is to CST Law in Sheffield.
