This is correct, but I did get a letter from the retailer saying it's OK to park there.

If I do reject this, do I need to email PE directly advising of my decision?

Also PE has to pay the court fee of £27 by 2nd December if they wish to pursue this so am I better off waiting until after the 2nd before I decide on my next step incase they don't pay the fee in which case the whole thing is cancelled anyway?

Really confused now as to whether just pay the £70 or do I go all the way and risk paying more!

Are the really likely to send a representative to the court over the Xmas period?!

I'd wait and see. Maybe send them a 'drop hands' offer (i.e. nobody pays anything and bears their own costs) and the claim is discontinued, given the retailer is alert to this one and wants it cancelled and discontinuing now will save ParkingEye the hearing fee and the three figure cost of a legal rep from LPC law, which cannot be recovered from the Defendant. Therefore this offer has significant value to ParkingEye and the retailer will be informed that the case is dropped (a win-win situation for all parties).

    Email:

    enforcement@parkingeye.co.uk

They have clearly been spooked by the fact the landowner wants it cancelled.

No problem with disagreeing or disagreement, but the initial post is nothing like what the later defence is claiming, I dont think we should be assisting any untruths, I won't be a party to fabrications, I leave that to the dubious private parking companies, but the case will play out one way or the other, possibly with screenshots from this thread

A slam dunk it isn't, ( a farce. ?  Possibly. Its hard to believe its the same case. !  )

14th January, troublemaker told the OP to be honest

15th January is when the retailer became involved, not on the incident date or afterwards, but after the claim form arrived

Let us see what happens by Xmas
I came on here looking for help and I have been honest about my situation. You mentioned that screenshots from this thread will be taken.  Why would you say that? I already feel stressed about the whole thing, I thought we were all here to help one another not inflict more stress!  As I mentioned in my very first thread, I've had a lot on my plate and nobody knows what anyone is going though so all I ask is for you to be kind.

If you genuinely don't wish to help me that's ok. I am not looking to cause trouble. All I wanted was some help and advice so thank you for yours.

Thank you, I will drop them an email tomorrow and see what they say. I guess I have until the 6th November to try and negotiate.

So yesterday I got an email from PE to the court requesting a notice of discontinuance and to vacate the claim! They finally backed down!

Just want to say a massive thank you to everyone for your help and support, I couldn't have done it without you!
