    Can I still say this as I have asked PE for all the information in a seperate email to them?  Can I also say that the local school which my child attends have agreed with the retailer that we can use the car park for school drop off. I then went shopping and must have overstayed. Since then I have spoken to the retailer who have confirmed they have no problem with this. (The store manager has even emailed me a letter to say its ok).

    They are a good couple of defence points. Add those to defence and keep the proof from the store manager for the witness statement and evidence stage.  You will need to obtain proof from the school in writing.

    3. The Defendant’s child attends a school about a 5minute walk away from the retailer’s car park. The school have advised that parents of children attending this school can park in the retailer’s car park for school drop off and pick up as they have an agreement in place.  The Defendant has consistently availaed themselves of this privilege for an extensive period spanning nearly 8 years, encountering no issues in doing so. Furthermore, the Defendant possesses written correspondence from the retailer, explicitly acknowledging the rescission of a parking charge incurred in September 2023. This concession stems from the Defendant's compliance with the store's protocol, wherein patrons exceeding a 2-hour shopping duration are advised to inform a staff member.

    Need to update this as the school have now said they don't have an agreement in place anymore. Not sure when this stopped! In addition to this PE replied back to me today saying they don't buy that I didn't get any letters and they will be pursuing this via the courts!!! 

    Updated defence below:

This concession stems from the Defendant's compliance with the store's protocol, wherein patrons exceeding a 2-hour shopping duration are advised to inform a staff member. In addition, it should be noted that the signage in the car park is not easily visible as the text is so small it can barely be seen nevermind read, not to mention extremely poorly lit.

    No that's not what happens.  As long as you get an email receipt (please don't show it to us...!) the claim will follow a known pathway.
