Advice wanted regarding Letter of Claim from DCB Legal

    As for my previous post regarding question D1 on the N180, since I've had no suggestions to modify the wording of my answer, I will submit as is.

    I intend to email it to the CNBC and info@DCB as stated on their N180 today

    Ok, it's been a while. Not had a lot to report recently hence my silence, but something today prompted me to come back and update...

    I was at work today and came back from my break to find I had a missed call from a number I didn't recognize.
    A few hours later I got a call from the same number. I picked up out of curiosity and was greeted by a TTS voice informing me that DCB was calling and wished to speak to me, and to press 1 to be connected.
    I hung up immediately.

    I'm a bit baffled as I've not heard anything else from the CNBC since I filed my Defence well over a month ago - I've yet to receive any instructions as to when the court date is and when to file my WS by...

    Could this mean that DCB might be jumping the gun and going straight to trying to get me to settle? I presume that if I'd stayed on the line I would've had one of DCB's thugs representatives asking to 'discuss the case' with me. So far I've had no emails, though wouldn't be surprised if any arrived next week

    Has anyone else had DCB call early like this? I'm not worried, just a little surprised. In any case this seems like a net positive.

    EDIT: Just looked at the MCOL Portal. It would appear that the case has been transferred to Luton! I guess that might explain DCB's early calls...

    Seems that discontinuation is all but inevitable at this point.

    What are the chances of them discontinuing before I submit my WS? Have there been any instances of this? 
    Just thought I'd ask because I expected to have had to submit my witness statement and be given a court date before they started trying to bargain...
    I'm still prepared to take this all the way regardless.

    Yes it's almost always just before WS stage.

    I would definitely answer the phone and play their little legal clerk like a toy.  Ask them to hurry up with the discontinuance.  Laugh if they say anything else.  Ask if they know they have zero chance at Luton.

    Again, laugh over them if they utter anything different.  Not their fault but these young people need the penny to drop who they are working for and the damage they and their ilk are doing to society AND to the small claims service.

    The fact that the CNBC were taken in enough to let generic parking roboclaims continue unabated and (as a result) practically fell over as a service, this past year, is IMHO mostly down to the weight of waste of time parking claims from firms with no intention of going to a court hearing.

    Even if I wanted to I've not had the chance - Haven't heard a peep out of them since last week! Not even one of their (In)Famous 'Without Prejudice to save on court costs' emails!
    Will remain vigilant of course, though I reckon we might be in the endgame now
  • Just received a formal letter today from the CNBC informing me what we already knew - that the case has been allocated to Luton and that the case will be reviewed by a Judge before sending a Notice of Allocation + directions.

    Interestingly I've still heard nothing more from DCB since they tried to call me. Not even one of their famous 'Without Prejudice' emails. That said, this letter was apparently sent to them too. Maybe this letter will nudge them in that direction...

    DCBL started the rubbish and they are left with ONLY two decisions
    GET SPANKED IN COURT
    DISCONTINUE

    OR, a judge will kick the case out
